What Is the State Farm UMPD Lawsuit About?
The lawsuit concerns diminished value, the loss in a vehicle’s market value that can remain even after quality repairs. When a car suffers structural or body damage, it often cannot be restored to its full pre-accident value, and the plaintiffs say State Farm owed them that difference under the UMPD coverage in its Washington policies.
Tyler Hardy and Jermine Santiago filed the lawsuit in January 2025. State Farm denies the allegations and denies doing anything wrong. The settlement resolves the dispute without a trial deciding who is right. The court granted preliminary approval in June 2026.
Who Qualifies for the State Farm UMPD Settlement?
You may be a class member if all of the following apply:
- State Farm insured you under an auto policy issued in Washington, and your repairs were paid under the policy’s UMPD coverage.
- The accident happened between January 13, 2019 and February 27, 2026.
- Your repair estimate, including supplements, totaled at least $1,000. This is the estimate, not what you paid out of pocket.
- Your vehicle was no more than six years old at the time of the accident (model year plus five years).
- Your vehicle had fewer than 90,000 miles at the time of the accident.
- The vehicle had structural or frame damage, deformed sheet metal, and/or needed body or paint work.
Meeting one requirement alone is not enough. They must be met together.

- Leased vehicles
- Vehicles declared a total loss
- Accidents outside the January 13, 2019 – February 27, 2026 period
If you had more than one qualifying accident, you must submit a separate claim for each accident.
How Much Could You Get?
There is no fixed payment. The administrator calculates each payment by comparing your vehicle’s repair costs with the total repair costs of all valid claims, after fees, costs and service awards come out of the fund. The administrator estimates the average payment at about $625, but that is only an estimate. Your amount could be higher or lower depending on your repair costs and how many people file claims.
If State Farm already paid you something for diminished value, that amount will be deducted from your settlement payment.

How to File a State Farm UMPD Settlement Claim
- Check your eligibility against the requirements above.
- Find your notice. Eligible class members were mailed a notice with a Class Member ID. The online form asks for it. If you lost it or never received one, call the administrator at (833) 930-0261 or use the Contact Us form on the settlement website.
- File online using the official claim form, or file by mail. The paper claim form is two pages and must be completed and signed. Mail it to: Hardy v. State Farm Mutual Automobile Insurance Co., c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.
- Meet the deadline. Online claims must be submitted, and mailed claims postmarked, by December 14, 2026.
- Keep copies of your claim and your repair and insurance records.
Payments will be made by paper check mailed to the address you provide.

Is the Settlement Approved? When Will Payments Go Out?
Not yet. Judge Ricardo S. Martinez will hold the final approval hearing on October 30, 2026, at 11:00 a.m. at the U.S. District Court for the Western District of Washington, 700 Stewart St., Seattle, WA 98101. He will decide whether the deal is fair, reasonable and adequate. The hearing date and time can change, so check the official website for updates.
Payments will go out only after final approval and after any appeals are resolved. There is no confirmed payment date. Be cautious of any site claiming checks have already been approved or issued.
Is This the Same as the Earlier State Farm UMPD Settlement?
No. State Farm Fire and Casualty Company previously settled a similar Washington diminished value case for $2,091,200, covering accidents from March 23, 2012 to February 13, 2024.
