Paraquat Lawsuit Update 2026, Settlement Status, Parkinson’s Claims, Deadlines and What Happens Next

Is There a Paraquat Settlement You Can Claim?

Not through a public claim form. A confidential Master Settlement Agreement exists for certain individual paraquat claims already filed in federal court, but its total value, payout tiers and per-person amounts have not been made public. There is no open claims portal, no public settlement fund and no universal deadline. Any dollar figures you see online are unverified estimates, not official terms.

What Is the Paraquat Lawsuit About?

Paraquat (paraquat dichloride) is a highly toxic herbicide used mainly in commercial agriculture to kill weeds and grasses. It has been registered in the United States since the 1960s and is sold under brand names including Gramoxone. The EPA classifies it as a Restricted Use Pesticide, so only certified applicators may use it, and homeowner use is not permitted. The European Union banned it in 2007, and many other countries ban or heavily restrict it.

The lawsuits allege that repeated exposure to paraquat contributed to Parkinson’s disease and that manufacturers knew or should have known of the risk and failed to warn users adequately. The defendants dispute both the allegations and the claimed causal link. The EPA says it has not found a clear link between paraquat exposure under labeled uses and Parkinson’s disease or cancer.

The existence of thousands of claims does not prove that paraquat caused any individual plaintiff’s illness. That question depends on scientific evidence, exposure history, product warnings and each plaintiff’s medical record.

Who Has Filed Paraquat Lawsuits?

Most plaintiffs allege occupational or significant exposure, such as:

  • Farmers, agricultural workers and farmhands who mixed, loaded or sprayed paraquat
  • People who lived or worked near fields where paraquat was regularly applied
  • Family members of exposed individuals, for wrongful death or loss-of-consortium claims

Claims generally require a Parkinson’s disease diagnosis and evidence of paraquat exposure. Most cases are in the federal MDL in Illinois, and additional cases proceed in state courts, notably Pennsylvania.

Which Companies Are Being Sued Over Paraquat?

Syngenta Crop Protection, LLC and Syngenta AG

Syngenta made and distributed paraquat products, including Gramoxone, and disputes the plaintiffs’ claims. In March 2026 the company announced it would stop global production of the paraquat active ingredient by the end of June 2026, citing commercial factors such as generic competition. That decision does not establish liability, and it does not ban paraquat products from the U.S. market.

Chevron U.S.A., Inc.

Chevron is a defendant because, according to the federal court’s description of the litigation, it manufactured and distributed paraquat before ending those activities in 1986. Claims against Chevron concern that historical role. A claimant may need to show which product was used, who made it, when exposure occurred and which state’s law applies.

How Many Paraquat Lawsuits Are Still Pending?

The Judicial Panel on Multidistrict Litigation’s October 1, 2026 report lists 6,602 pending actions out of 8,495 historical actions in MDL No. 3004. These are counts of court actions, not of every person who may have been exposed, and they do not mean every case is eligible for settlement. The cases are consolidated for coordinated pretrial proceedings, but each plaintiff must still prove exposure, diagnosis and causation.

Paraquat Settlement Update: What Has Actually Been Agreed?

The federal court’s April 8, 2026 Case Management Order No. 24 states that counsel for plaintiffs and defendants executed a Master Settlement Agreement in 2025 covering certain individual paraquat claims. The order also gave court-appointed Special Master Randi Ellis responsibilities over settlement administration, eligibility and qualification decisions, and directed administrators to report on which plaintiffs qualified, accepted, opted out or had not yet decided.

Is There a Confirmed Total Settlement Amount?

No. No total value or per-person payout schedule appears in the public court records reviewed. Law firm marketing pages publish projected ranges, from tens of thousands of dollars to over a million, but these are not the official value of the agreement and are not guaranteed payments.

Is the Paraquat Settlement a Class Action Settlement?

No. The MDL is a set of individual cases. No court has approved a single public fund open to everyone exposed to paraquat. Someone with Parkinson’s disease and a history of exposure should not assume they automatically qualify.

Can Someone Still Accept a Paraquat Settlement Offer?

Public orders show some plaintiffs accepted offers, others declined and others had not decided. Whether an individual can still accept or reconsider depends on the agreement, their case status and applicable deadlines. A person with a pending case should ask their own attorney about the offer, the release of claims and any liens or expenses that could be deducted.

Why Are Some Paraquat Plaintiffs Rejecting Settlement Offers?

The court’s June 2, 2026 order stated that, based on information then before it, more than 90% of the Smith Law Firm’s plaintiffs and all plaintiffs represented by DiCello Levitt had declined the offers presented to them. Those figures reflect that moment in the record and are not a current acceptance rate for the whole MDL. Reporting indicates that hundreds of plaintiffs have opted out in total.

Plaintiffs may decline for different reasons: disagreement with how their exposure or disease severity was assessed, the size of the offer, or a wish to keep litigating. Anyone weighing an offer should rely on the actual offer and release language, not online estimates.

What Is the Latest Paraquat Court Order From October 2026?

The newest orders concern non-participating plaintiffs represented by the Smith Law Firm. They do not automatically apply to every claimant in the MDL.

October 6, 2026: Case Management Order No. 26

Judge Rosenstengel ordered non-participating Smith Law Firm plaintiffs to comply with earlier case-management requirements for information about their cases, including materials on exposure, diagnosis, treatment history, applicable law and supporting evidence.

October 15, 2026: Case Management Order No. 27

After an October 14 hearing, the court set these requirements:

RequirementCourt-ordered date
Law firm’s private disclosure of financial interests in the casesOctober 21, 2026
Verified Plaintiff Fact SheetOctober 28, 2026
Production of medical recordsOctober 28, 2026
Status conference on attorney R. Allen Smith’s casesNovember 5, 2026, 9:30 a.m. Central
Depositions of affected plaintiffsNo later than February 16, 2027

The financial-disclosure requirement covers anyone with a direct or indirect financial interest in the cases, including litigation funders, law firms and lead-generation companies, and it is submitted privately to the judge (in camera). Reporting also indicates the court required these plaintiffs to take part in periodic conferences so it can speak with them directly.

The October 21 and 28 dates have passed. The public orders reviewed do not show whether every required item was filed or whether the court has imposed further consequences.

What Does the June 2026 Discovery Order Require of Plaintiffs Who Continue Their Cases?

Case Management Order No. 25 (June 12, 2026) sets out what certain plaintiffs who declined offers must provide so their cases can continue:

  • A verified Plaintiff Fact Sheet
  • Medical records and a summary of relevant medical information
  • Evidence of paraquat exposure
  • The state law the plaintiff argues applies
  • Information on diagnosis, medical history and alleged injury
  • Documentation that the plaintiff and counsel have investigated the claim

Rejecting an offer does not let a case sit indefinitely without supporting evidence. The court uses case-specific discovery to decide whether claims are substantiated and can move toward trial. Bellwether (test) trials in the federal MDL have been delayed or stayed while settlement efforts continue, and some individual cases, including state-court matters, have resolved on confidential terms.

What Is the Scientific Dispute Over Paraquat and Parkinson’s Disease?

Parkinson’s disease is a progressive neurological disorder. Some studies report associations between pesticide exposure and Parkinson’s disease, but study designs, exposure measures and findings vary and are not uniform. The EPA says it reviewed hundreds of studies, including epidemiological research, found their quality varied and results conflicted, and has not found a clear link under labeled uses. That is the regulator’s stated position, and a court must still weigh the evidence presented in each product-liability claim.

Two legal questions are central:

  • General causation: can paraquat cause Parkinson’s disease at all?
  • Specific causation: did exposure actually cause this plaintiff’s illness?

A diagnosis and an exposure history are important facts, but they do not automatically prove that paraquat caused the disease.

Why Were the First Paraquat Bellwether Cases Dismissed?

Bellwether cases are selected lawsuits used to test common issues before trial. The first paraquat bellwethers did not reach trial after the court excluded key plaintiffs’ expert testimony in 2024. The court described them as having failed a Daubert challenge, the federal standard for deciding whether expert testimony is reliable and relevant enough to be admitted.

That did not dismiss every paraquat lawsuit. The court selected further cases for individualized discovery, and the litigation shifted toward settlement. The earlier expert rulings still matter, because plaintiffs who continue must prove causation with admissible evidence.

How Could the Supreme Court’s 2026 Roundup Ruling Affect Paraquat Lawsuits?

On June 25, 2026, the U.S. Supreme Court decided Monsanto Co. v. Durnell, a Roundup (glyphosate) case. The Court held that the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) expressly preempted the failure-to-warn claim at issue, because it would have required a cancer warning different from the label EPA had approved.

FIFRA governs pesticide registration and labeling, and 7 U.S.C. § 136v(b) generally bars states from imposing labeling requirements different from or in addition to federal ones. The ruling concerned Roundup, not paraquat, and it did not decide the Paraquat MDL. It may affect arguments about state-law failure-to-warn claims, but it does not automatically defeat negligence, design-defect or other product-liability theories. No published order applying Durnell to resolve the consolidated paraquat claims has been verified as of October 29, 2026.

Is Paraquat Banned in the United States?

No. The EPA still lists paraquat as a registered, restricted-use herbicide. Only trained, certified applicators may use it, with required personal protective equipment, restrictions on some application methods, limits on some aerial applications and restricted-entry intervals for treated fields. The EPA warns that paraquat is highly toxic and that ingestion can be fatal. That acute toxicity is separate from the disputed question of whether it causes Parkinson’s disease.

Who May Qualify for a Paraquat Lawsuit?

There is no single public eligibility form. Eligibility depends on the facts and state law. Factors that may matter include:

  • A Parkinson’s disease diagnosis. The MDL centers on this diagnosis, but a diagnosis alone does not establish the other legal elements.
  • Evidence of paraquat exposure. Work history, pesticide application records, product labels, purchase records, employment documents and witness testimony can help. The evidence needs to tie the person to paraquat, not just to pesticides generally.
  • Timing and duration. Frequency of use, length of work and time between exposure and diagnosis can bear on causation and damages. Stronger claims typically involve documented occupational exposure over years plus a clear diagnosis.
  • Medical history. The court may examine records and consider other explanations for the disease.
  • State filing deadlines. Statutes of limitation vary by state and can depend on where exposure occurred, where the person lived, when they were diagnosed and which law applies. There is no national deadline.

There is no guarantee of recovery. Outcomes depend on the strength of each case, the medical evidence and the terms of any settlement or verdict.

Can New Claimants Join the Paraquat Settlement?

New cases can still be filed, though the litigation is mature and settlement is advanced. The Master Settlement Agreement covers certain individual claims already in the litigation. It is not an open invitation for every paraquat user to file through a public website, and no universal enrollment form or public deadline has been verified.

People with existing lawsuits should ask their own counsel about their settlement status and deadlines. People who have not filed should not assume they can join the existing settlement. They should seek individualized legal advice promptly, because statutes of limitation may limit the time available.

What Could Paraquat Settlement Payments Look Like?

Matrix tiers and individual amounts have not been publicly disclosed. A claimant’s recovery, if any, may depend on the agreement’s criteria, exposure evidence, medical documentation, diagnosis history, claimed damages and allocation rules. One claimant’s offer does not indicate what another will receive. Before accepting, a claimant should understand what claims they are releasing, what liens or case expenses may be deducted and how the offer compares with the risks and costs of continuing.

What Happens Next in the Paraquat Lawsuit?

Date or periodWhat it means
November 5, 2026Status conference on attorney R. Allen Smith’s cases
Through February 16, 2027Deposition deadline for non-participating Smith Law Firm plaintiffs
OngoingSpecial master review of settlement eligibility and offers
OngoingCase-specific discovery for plaintiffs who continue litigating

The timetable for other claimants depends on the orders in their own cases. The litigation may move toward further settlements, case-specific proceedings or trials. No universal payout date has been verified.

What Should Paraquat Claimants Do Now?

If you already have a pending lawsuit, ask your attorney whether you received an offer, whether it is still open, whether you accepted or declined it and what discovery deadlines apply. If you have not filed, preserve records of paraquat exposure and your diagnosis and get advice about deadlines. Do not rely on an online estimate as a promise of compensation. Make medical decisions with your healthcare professionals, not based on litigation news.
