Current Status & What Happens Next

What Is the Endue Software Data Breach Lawsuit About?
The lawsuit alleges that during a February 2025 targeted cyberattack on Endue’s computer systems, certain files containing private information were accessed. Endue Software is a platform used by healthcare and pharmaceutical organizations to manage infusion therapy — meaning its systems contain sensitive patient and personal health data.
The case — Pauley, et al. v. Endue, Inc. d/b/a Endue Software, Case No. CACE-25-015155 — is pending in the 17th Judicial Circuit in and for Broward County, Florida. The class representatives are Robert Pauley, Moira Polite, Elizabeth Healy, and Daniel Martinez, the last acting on behalf of a minor.
Endue denies that it did anything wrong, and the court has not decided who is right. Both parties agreed to settle to avoid the costs, risks, disruptions, and uncertainties of continuing the litigation.

Who Is Eligible to File a Claim?
- You may qualify if you are a living individual residing in the United States whose private information may have been impacted in the February 2025 Endue Software data incident
- You may qualify if you received a notice directly from Endue about the data incident — this is the strongest indicator of eligibility
- You may qualify even if you did not receive a notice, as long as Endue’s records identify you as someone whose data was affected
- You are not eligible if you are a director, officer, or agent of Endue Inc.; a governmental entity; or a judge, their immediate family, or court staff assigned to this case

How Much Can You Receive?
The settlement offers two types of cash payments. You may claim only one. Every class member also receives free medical monitoring regardless of which cash option they choose.
Cash Payment A — Documented Losses (Up to $2,500)
If you incurred actual, documented out-of-pocket losses related to fraud or identity theft due to the data incident, you can receive up to $2,500. The losses must have occurred between February 16, 2025, and June 30, 2026.
Covered expenses include:
- Losses from identity theft or fraud
- Fees for credit reports, credit monitoring, or freezing and unfreezing credit
- Costs to replace IDs
- Postage to contact banks by mail
You need to submit proof such as receipts. Personal certifications, declarations, or affidavits alone are not sufficient documentation, but you may include them to provide clarification or support for other submitted documentation. You cannot claim a payment for expenses already reimbursed by a third party.
Cash Payment B — Alternate Cash Payment ($65, No Documentation Required)
Instead of the documented loss payment, you may claim a one-time $65 alternate cash payment with no documentation required.
There is an alternate cash payments fund of $260,000. If the total for all alternate cash payment claims exceeds $260,000, everyone’s payment will be reduced pro rata. If total claims are less than $260,000, everyone’s payment will be increased pro rata. In plain terms: if fewer people file, your $65 could go up; if more people file than the fund supports, it could go down.
Free Medical Data & Credit Monitoring (All Class Members)
All settlement class members are eligible to enroll in two years of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance and monitoring for healthcare insurance ID exposure, Medical Record Number (MRN) exposure, and unauthorized Health Savings Account (HSA) spending. This benefit is available to every class member regardless of which cash payment option they select — or even if they only want the monitoring and skip the cash claim.

Step 4 — If filing for documented losses, upload your supporting receipts or proof of out-of-pocket expenses
