What Is the Valsartan, Losartan & Irbesartan Lawsuit About?

Aurobindo agreed to a $2 million settlement, Hetero agreed to an $11,365,489.80 settlement, and Vivimed agreed to a $1,899,000 settlement to resolve claims that their irbesartan, valsartan, and losartan blood pressure medications were contaminated with cancer-causing substances.

The class action alleged that medications from Aurobindo (irbesartan), Hetero (valsartan), and Vivimed (losartan) were contaminated with nitrosamine impurities — NDEA, NDMA, and NMBA, respectively — all alleged to be human carcinogens. Nitrosamines are chemical compounds that the FDA and international health agencies classify as probable human carcinogens.

The plaintiffs argued that each manufacturer knew or should have known that its medication contained these impurities, but allegedly failed to warn consumers and retailers about the contamination. As a result, consumers overpaid for medications they received that were not what was represented. Who Is Eligible to File a Claim?

You may qualify for the Aurobindo (Irbesartan) settlement if:

  • You are an individual in the United States or its territories
  • You paid any amount for retail purchases of irbesartan finished drug formulations manufactured using Aurobindo’s IC Route of Synthesis (IC ROS) API
  • Your purchases occurred from January 1, 2016 to the present

You may qualify for the Hetero (Valsartan) settlement if:

  • You are an individual in the United States or its territories
  • You paid any amount for retail purchases of valsartan formulations using Hetero Process III API
  • Your purchases occurred between May 1, 2018 and July 31, 2018

You may qualify for the Vivimed (Losartan) settlement if:

  • You are an individual in the United States or its territories
  • You paid any amount for retail purchases of losartan finished drug formulations sold under one of these specific National Drug Codes (NDCs): 23155-644-09; 23155-644-10; 23155-645-03; 23155-645-09; 23155-645-10; 23155-646-03; 23155-646-09; or 23155-646-10

How Much Can You Receive?

Payouts differ across the three settlements based on which medication you took:

Aurobindo – Irbesartan Class members who paid out of pocket can receive a reimbursement of up to $100. Class members who have documentation of their purchases can receive a larger reimbursement of up to $200.

Hetero – Valsartan Consumers can generally receive up to $40 for each 30-day supply purchased, with a maximum total payment of $120. However, consumers who can sufficiently document purchases in excess of $40 for a 30-day supply may receive a higher payment without regard to the standard caps.

Vivimed – Losartan Payment amounts for individual Vivimed class members have not yet been specified, as the allocation method is to be determined by class counsel and reviewed by the court prior to the final approval hearing.

All payouts are subject to pro-rata reduction — meaning if total valid claims exceed the fund amount, each payment may be reduced proportionally. Submitting documentation increases both the amount you can claim and the likelihood your claim gets approved at the higher tier.
