What Is the Coast Dental Lawsuit About?

Sebastian Chaviano sued Coast Dental Services on behalf of himself and a nationwide class. He alleges the company kept sending text messages and making calls to his cell phone after he asked it to stop, in violation of the federal TCPA and Florida’s FTSA. The lawsuit seeks actual and statutory damages.

Coast Dental denies the allegations and any liability, and disputes that the case could proceed as a class action at trial. The court has not decided who is right. The parties agreed to settle to avoid the cost and uncertainty of continued litigation. Coast Dental also agreed to adopt policies and procedures intended to comply with the TCPA and FTSA.

Who Qualifies for the Coast Dental Settlement?

The settlement is nationwide. You may be a class member if all of the following apply:

  1. You were located in the United States.
  2. You received more than one text message or phone call from Coast Dental within any 12-month period.
  3. The messages reminded or encouraged you to schedule an appointment with Coast Dental.
  4. They were sent to your cell phone number.
  5. Before receiving them, you had asked Coast Dental to stop by replying “STOP” or a similar opt-out instruction to one of its texts.

The class period begins April 14, 2021 and runs through the date the settlement agreement was executed.

The class excludes the judge, Coast Dental and certain related parties, the other released parties, their immediate family members, class counsel and their employees, and anyone who validly opts out.

Two points are worth knowing. The fund is a ceiling, not a pot split among whoever files. According to the settlement agreement, money not claimed by class members, after fees, costs and the service award, stays with Coast Dental.

How to File a Coast Dental Settlement Claim

  1. Gather your details. The form asks for your name, current address, the phone number that received the Coast Dental text or call, your current phone number, and your email address if you have one.
  2. Choose cash or voucher.
  3. File online through the official claim portal. If you received a notice, you may need the claim number and PIN printed on it. Or file by mail. Opting out: Mail a signed letter, under penalty of perjury, saying you want to be “excluded from the Settlement Class.” You cannot opt out by phone, email or the settlement website. Send it to CDS TCPA Settlement, PO Box 2009, Chanhassen, MN 55317-2009.

Objecting: File your objection with the court and mail copies to the Clerk of the Court, class counsel and Coast Dental’s counsel. The notice lists the required items, including the case number, the cell number that received the texts, a signed statement under penalty of perjury that you are a class member, and your reasons. You can only object if you do not opt out.

If you stay in the class, you give up the right to sue Coast Dental and the other released parties over the issues in this case.

Final Approval Hearing

Judge Javier A. Enriquez will hold the final approval hearing on December 9, 2026, at 10:30 a.m. by Zoom. The court will consider whether the settlement is fair, reasonable and adequate, along with the requested fees, expenses, service award and any timely objections. The hearing may be moved without further notice, so check the settlement website for updates. You do not need to attend to receive a payment.

When Will Payments Be Sent?

Not yet. Payments go out only after final approval and after any appeals are resolved. Once the settlement takes effect, the agreement says valid claims will be paid within 60 days of the Effective Date. Checks are valid for 90 days from the date on the check, so cash yours promptly.
