You get nothing unless you submit a claim. You also give up the right to sue Teleflora over these texts unless you opt out by the same date. The $251 is a maximum, not a guaranteed check. The settlement has been preliminarily approved but not yet finally approved, and Teleflora denies the allegations.

What the Teleflora Lawsuit Is About
Vickie Carter filed the lawsuit on June 26, 2026. She claims Teleflora sent telemarketing text messages to cell phone numbers on the National Do Not Call Registry without consent. The notice says the claims arise under the federal Telephone Consumer Protection Act (TCPA) and the Virginia Telephone Privacy Protection Act.
Teleflora denies the allegations and says it followed the law. The court has not ruled for either side. The court’s preliminary findings were made for settlement purposes only and were not a decision on the merits. The settlement is a compromise that lets both sides avoid the cost and risk of a trial.
What the TCPA says about Do Not Call texts
The TCPA’s Do Not Call provisions let a person who gets more than one telemarketing call in any 12-month period from the same company sue for up to $500 per violation, and a court can increase that amount if the violation was willful or knowing (47 U.S.C. § 227(c)(5)). Courts treat text messages as calls under the law. That is why a lawsuit over marketing texts can be brought on behalf of thousands of people at once.
Who Qualifies for the Teleflora Settlement
The court conditionally certified the following settlement class, for settlement purposes only. You are in it if all three of these are true:
- You did not give your telephone number to Teleflora LLC.
- Teleflora delivered, or caused to be delivered, more than one promotional text message to you within a 12-month period.
- Your residential or cell number was on the National Do Not Call Registry for at least 30 days before Teleflora sent at least two of those texts in the 12-month window.
The class covers texts from May 9, 2021 through the date of preliminary approval, which the court signed on August 26, 2026. The parties estimate about 23,844 phone numbers are in the class.

How to find out if you are included
Class membership is based on calling records obtained for the case. If your name and number appear in those records, you may have received a postcard from the administrator. A postcard is not required. If you did not get one, call the settlement administrator at 1-833-662-3434 with your name and cell phone number, and they will check it against the records. Do not assume that not getting a postcard means you are excluded.
How Much Money Can You Get From the Teleflora Settlement?
Class members with approved claims get an amount not to exceed $251, less their share of two costs: settlement administration expenses and the attorneys’ fee award. Only one claim per class member per phone number is validated. If you had two numbers that qualify, each is treated separately, but a single number can only be claimed once.
Where the $6 million goes
The $6,000,000 settlement sum pays for everything: approved claims, administration costs, and any attorneys’ fees, costs, and expenses the court awards. Class counsel say they will ask for fees of up to one-third of the settlement sum (up to $2,000,000), plus reimbursement of out-of-pocket expenses. The court decides the actual amount. Class members do not pay class counsel directly.
Our arithmetic: dividing the full $6,000,000 by the roughly 23,844 phone numbers gives about $251.64, which lines up with the $251 cap. If the fee request were approved at the maximum and every estimated number filed a claim, the remaining $4,000,000 would work out to about $168 per number before administration costs. The notice does not publish an expected payment after deductions, so treat $251 as a ceiling, not a promise.
Do You Need Proof of the Teleflora Texts?
The claim form does not ask you to upload copies of the texts or phone records. It asks for identifying information and certifications. It does say your claim may be subject to audit, verification, and court review, so only claim numbers you actually used. If you still have the texts, keeping them for your own records is sensible, but follow the form’s requirements rather than sending documents it does not ask for.
How to File a Teleflora Settlement Claim
- Online: Go to TFSettlement.com and click Submit a Claim. You must file by 11:59 p.m. PST on November 17, 2026.
- By mail: Print and complete the claim form from the Important Documents page. It must be postmarked on or before November 17, 2026. Send it to: Teleflora TCPA Settlement Administrator, ATTN: CLAIM FORMS, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103.
The claim form asks for:
- Your name and your Claimant Identification Number (both required)
- Your street address, city, state, ZIP, and preferred phone number (required)
- Your email address (optional)
- The phone number or numbers you regularly used from May 9, 2021 to the present that got at least two promotional Teleflora texts in a 12-month period while on the Do Not Call Registry
- A signature or electronic signature confirming the information is true
If you received a settlement notice, keep it handy, because it contains your identifying information. If your form is incomplete, the court order lets the administrator send you a notice so you can fix it. Payments go out by mailed check, so use an address where you will actually receive mail.
Do not pay anyone to file a Teleflora claim for you. The official settlement materials provide the claim process directly.

How to opt out of the Teleflora settlement
Mail a letter to Teleflora TCPA Settlement Administrator, Attn: Exclusion Requests, P.O. Box 58220, Philadelphia, PA 19102, postmarked by November 17, 2026. It must be signed and dated and include your full name, address, and the phone number that got the texts. It must say you want to be excluded from the litigation and the agreement. You cannot opt out by phone, email, or the website, and you cannot opt out on behalf of anyone else.
How to object to the Teleflora settlement
Your letter must be headed “Objection to Class Settlement in Carter v. Teleflora LLC No. 2026-012979-CA-01″ and include your contact information, the factual basis and legal grounds for the objection, the phone number you received texts on, and any past class action objections you or your attorney have filed. File it with the court’s electronic system or mail or deliver it to the Clerk’s Office for Miami-Dade County, 601 NW 1st Court, 16th Floor, Miami, FL 33136, by November 17, 2026. You can only object if you have not opted out.
Key Dates in the Teleflora Settlement
| Date | Event |
| May 9, 2021 | Class period begins |
| June 26, 2026 | Lawsuit filed |
| August 26, 2026 | Judge Mavel Ruiz enters the Agreed Order preliminarily approving the settlement and conditionally certifying the class |
| November 17, 2026 | Claims, opt-out requests, and objections are all due |
| November 25, 2026, 9:00 a.m. EST | Final approval hearing, held remotely |
The hearing date can change without another mailed notice, so check TFSettlement.com. As of October 7, 2026, you have 41 days to file a claim, opt out, or object.
What Happens at the Final Approval Hearing?
At the hearing, the court will decide whether the settlement is fair, reasonable, and adequate, and will consider the requested attorneys’ fees and expenses and any timely objections. It is scheduled before Judge Mavel Ruiz and will be held remotely. You do not have to attend. Class counsel will answer the court’s questions, and you can attend at your own expense. You can only ask to speak if you timely objected and did not exclude yourself.
When Will Teleflora Settlement Payments Be Sent?
There is no payment date yet. Payments are made only after the court grants final approval and any appeals are resolved. The notice says it is unknown how long the court will take to decide afterward, and appeals can add more time. Do not expect a check right after the November 17 claim deadline or the November 25 hearing.
Who Represents the Teleflora Settlement Class
The court appointed Avi Kaufman as class counsel in its August 26 order, and the notice also lists Anthony Paronich. You do not pay them directly. Their fees come out of the settlement sum if the court approves. You can hire your own lawyer, but you would pay that lawyer yourself.
Common Mix-Ups to Avoid
- $251 is a maximum, not a guaranteed payment.
- Filing a claim, opting out, and objecting all share the same November 17 deadline, but they are different choices.
- Not getting a postcard does not mean you are excluded.
- Not filing a claim means no money, but you can still be bound by the settlement.
- The settlement is preliminarily approved, not final.
