One claim form covers every qualifying text and call you received, and you get one payment per person. The administrator checks claims against Al Piemonte Nissan’s records and may ask for more information. If you do not answer in time, the claim is invalid and will not be paid. Keep a copy of your claim and any confirmation. Filing is free, and you do not need a lawyer.

Who Qualifies for the Al Piemonte Nissan TCPA Settlement?

The court defined the class as all persons in the United States who, from May 9, 2021 through September 1, 2026:

  • Were sent a text or received a call by or for Al Piemonte Nissan more than once within any 12-month period.
  • Had a residential number listed on the National Do Not Call Registry for at least 30 days before the contact.
  • Were contacted to sell Al Piemonte Nissan’s products or services.
  • Had no established business relationship with Al Piemonte Nissan and had not given prior express written consent.

If you got a notice by email or postcard, it is because records show your number was contacted during that period. Buying a car from the dealership does not decide eligibility. The registry, timing, purpose and consent rules do. One call or text alone does not meet the definition.

A note on the class-period end date. The FAQ’s court-approved class definition ends on September 1, 2026, while the claim portal’s introductory text refers to September 16, 2026 (the preliminary approval date). The class definition controls. If your qualifying contacts happened between September 2 and September 16, 2026, ask Simpluris before relying on this summary.

Do text messages count? The settlement class definition includes both texts and calls. A July 14, 2026 Seventh Circuit decision, Steidinger v. Blackstone Medical Services, No. 25-2398, held that the private right of action in 47 U.S.C. § 227(c)(5) for Do Not Call violations does not cover text messages alone. That ruling is relevant background, especially for text-only claims, but it does not decide whether this Illinois state-court settlement is approved. Read the opinion. Text-message TCPA cases keep multiplying, as in AT&T, State Farm and CVS Hit With Five TCPA Text Message Class Actions, and other text-based settlements have paid out, such as Teleflora Text Message Settlement Claim Up To $251 By Nov 17.

What Do You Get From the Al Piemonte Nissan TCPA Settlement?

Choose one: $20 cash or a $100 voucher that is non-expiring and redeemable for products or services from Al Piemonte Nissan. The voucher is not cash you can spend anywhere, so if you do not plan to buy from the dealership, the cash option may suit you better. Read the voucher terms in the official documents first.

Amounts can be reduced. If the fund cannot cover every valid claim at the stated amount, payments are reduced pro rata. If money remains after all payments, it goes back to Al Piemonte Nissan.

The settlement fund also pays notice and administration costs, court-approved attorneys’ fees and costs, and any service award. Class counsel will ask for $225,000 in fees, costs and expenses (their request is due by December 17, 2026) and a service award of up to $5,000 for the named plaintiff. The court may award less.

What Is the Al Piemonte Nissan Lawsuit About?

Hazem Arman alleges that Al Piemonte Nissan violated the federal Telephone Consumer Protection Act by sending more than one marketing text or making more than one marketing call within 12 months to residential numbers on the National Do Not Call Registry for at least 30 days, without express written consent or an established business relationship. Al Piemonte Nissan denies this, and both sides settled to avoid the cost and risk of continued litigation. The settlement is not a finding of liability.

What Laws Apply to the Al Piemonte Nissan TCPA Lawsuit?

  • Telephone Consumer Protection Act, 47 U.S.C. § 227. Section 227(c)(5) lets a person who received more than one call in 12 months in violation of the Do Not Call rules seek actual loss or statutory damages, whichever is greater, up to $500 per violation and more for willful or knowing violations. Those are statutory remedies in an individual suit, not the amounts offered here.
  • FCC rules, 47 C.F.R. § 64.1200. These bar telephone solicitations to residential numbers on the registry, subject to exceptions such as an established business relationship or prior express permission.
  • Illinois settlement approval. At the January 6, 2027 hearing, the court decides whether the settlement is fair, reasonable and adequate, and hears objections and the fee and service award requests.

For a similar settlement with a cash payment, see ConnectAmerica TCPA Settlement, Claim Up To $275 By Dec 21. Each case has its own class definition and terms, so eligibility in one does not carry over to another.

When Will Al Piemonte Nissan Settlement Payments Be Sent?

No payment date has been announced. Nothing is paid until the court approves the settlement on or after January 6, 2027 and all appeals are final. The FAQ warns that appeals can take more than a year. The hearing date and time can change by court order, so check the official dates page.
