Prime Healthcare $2 Million Patient Privacy Settlement, Who Can Claim $20 and Free Identity Protection?
Prime Healthcare has agreed to settle a class action lawsuit alleging that tracking technologies on its websites violated patients’ privacy rights. Eligible patient portal users can claim a one-time $20 cash payment and may also receive one year of identity-protection services. Certain other patients are eligible for the identity-protection service without submitting a claim.
The claim deadline is December 21, 2026, and the opt-out deadline is the same day. Written objections are due January 20, 2027, and the court’s final approval hearing is scheduled for March 9, 2027.
One important point about the widely reported $2 million figure: the official settlement FAQ says class counsel will ask the court to approve up to $2 million in attorneys’ fees, costs and expenses, paid directly by Prime Healthcare. That is not a $2 million cash fund divided among patients. The published benefit for an eligible patient portal user is $20, subject to a valid and timely claim.
Prime Healthcare denies wrongdoing. The court has not decided whether the allegations are true, and the proposed settlement is not a finding that the company violated privacy laws.

What Is the Prime Healthcare Privacy Lawsuit About?
The lawsuit, Doe, et al. v. Prime Healthcare Services, Inc., et al., concerns Prime Healthcare’s alleged use of third-party tracking technologies, including tracking pixels, on its web properties. Tracking pixels are small pieces of code that can report information about activity on a website to an outside service, such as which pages someone visits or whether they interact with certain features. Similar claims have been settled by other providers, including the Tenet Healthcare tracking pixel class action settlement.
The plaintiffs allege that Prime Healthcare’s use of these tools violated state and federal privacy laws. The settlement agreement identifies claims under laws including the California Invasion of Privacy Act, the Confidentiality of Medical Information Act, the California Unfair Competition Law and the federal Electronic Communications Privacy Act, among others.
The settlement addresses allegations about online tracking. It is not a finding that every class member’s medical records, diagnosis or treatment information was sent to an outside company, and it does not establish that every patient experienced a disclosure or financial loss. Both sides agreed to settle to avoid the costs, risks and uncertainty of further litigation, and the court has not ruled that the defendants are liable.
Who Qualifies for the Prime Healthcare Settlement?
The official materials describe a broad Settlement Class and two groups entitled to specific benefits: the Patient Portal Subclass and the Email Subclass. Not everyone included in the settlement can claim the $20 payment.
1. Patient Portal Subclass: Eligible for $20
You may qualify for the $20 cash payment if you were a patient of Prime Healthcare or a relevant hospital and accessed or used one of the qualifying Prime Healthcare patient portals during the applicable period. The general class period begins November 1, 2019, but the end date differs by website or hospital, so check the specific property in the official FAQ.
A valid and timely claim form is required for the $20. Eligible Patient Portal Subclass members also receive an activation code for one year of CyEx Medical Shield Pro, with no separate claim needed for that service.
2. Email Subclass: Eligible for identity protection
The Email Subclass covers qualifying patients at specified California hospitals who were patients from November 1, 2021, through the relevant website’s class-period end date and who gave Prime Healthcare an email address.
These members receive one year of CyEx Medical Shield Pro and do not need to submit a claim for it. Providing an email address does not by itself qualify you for the $20; the cash benefit is for qualifying Patient Portal Subclass members.
3. Other Settlement Class members
People who meet the broader Settlement Class definition but are not in either subclass may still benefit from the settlement’s website-privacy requirements. However, the official FAQ says they do not receive the $20 payment or a CyEx Medical Shield Pro code.

The cash benefit is limited to eligible Patient Portal Subclass members. See the official settlement FAQ for the controlling definition.
How Much Money Can You Receive?
The $20 cash payment
Eligible Patient Portal Subclass members can claim a one-time $20 payment by submitting a valid and timely claim. The settlement does not advertise a larger payment based on individual spending or a reimbursement program for documented identity-theft losses. For comparison, the Fairchild Medical Center pixel privacy settlement offers a different flat payment under its own terms.
The $2 million figure in headlines relates to the attorneys’ fee and expense request, which the court must still approve. The agreement also provides for proposed service awards of $3,000 for each of five class representatives, plus settlement administration expenses.

One year of CyEx Medical Shield Pro
Eligible Patient Portal and Email Subclass members receive an activation code for one year of CyEx Medical Shield Pro. The FAQ describes the service as offering:
- Dark-web monitoring for personal information.
- Medical record number monitoring.
- Real-time authentication alerts.
- Security-freeze assistance across as many as 10 consumer reporting agencies, including the three major credit bureaus.
- Identity-theft recovery assistance.
- Up to $1 million in identity-theft insurance, subject to the service’s coverage terms.
You do not need a separate claim, but you must activate the code. The enrollment deadline is April 20, 2027, and the FAQ says codes must be used within 180 days of issuance. Do not share your code with anyone else.
How to File a Prime Healthcare Settlement Claim
Only eligible Patient Portal Subclass members need to submit a claim for the $20, and the deadline is December 21, 2026.
- Check your settlement notice. Look for the email or mailed notice. If you are eligible for cash, it should contain a unique Class Member ID needed for the online form. If you lost it or are unsure whether you qualify, contact Kroll before submitting information.
- Complete the online claim form. Visit the official Prime Healthcare claim form and enter your Class Member ID. The form may require JavaScript.
- Submit by December 21, 2026. You can instead download the Patient Portal Class Member Claim Form (PDF), sign it and mail it to:
Prime Healthcare Pixel Settlement
c/o Kroll Settlement Administration LLC
P.O. Box 225391
New York, NY 10150-5391
Online claims must be submitted, and mailed claims postmarked, by December 21, 2026. Keep a copy of your form and any confirmation.
Do You Need to Claim the Free Identity Protection?
No. Eligible Patient Portal and Email Subclass members do not file a claim for CyEx Medical Shield Pro. Their activation code and instructions came with their notice. If you believe you qualify but did not receive a code, ask the administrator to check your status.
What Is the Deadline to Opt Out?
The opt-out deadline is December 21, 2026. Opting out excludes you from the settlement: you would not receive the $20 or the Medical Shield Pro code, but you may preserve any right to pursue the covered claims separately.
A valid exclusion request must say that you want to be excluded and include your name, address, and email address or telephone number. It may be mailed or emailed to:
Prime Healthcare Pixel Settlement
c/o Kroll Settlement Administration LLC
Attn: Request for Exclusion
P.O. Box 225391
New York, NY 10150-5391
Email: [email protected]
It must be postmarked or emailed by December 21, 2026. Check the official FAQ for current instructions before sending it.
Can You Object to the Settlement?
Yes. Class members who do not opt out may object to the settlement or specific terms. The objection deadline is January 20, 2027, and objections follow the instructions in the official notice. The court may also allow a class member to speak at the final approval hearing.
Objecting is different from opting out: an objection tells the court why you oppose or support a term while you remain in the class. Do not opt out if you only want to voice a concern.
What Happens If You Do Nothing?
If you are an eligible Patient Portal Subclass member and do nothing, you will not receive the $20. If your notice included a Medical Shield Pro code, the FAQ says you may still use it by activating it before the deadline. Eligible Email Subclass members likewise only need to activate their code.
Other class members receive no cash payment or code, but may benefit from the website-privacy requirements. If you stay in the settlement without opting out, you give up the right to bring or continue covered claims against the defendants over the conduct the agreement resolves.
What Will Prime Healthcare Have to Change?
For five years after final approval, Prime Healthcare must refrain from using Google Analytics and the Meta Pixel on the covered Prime web properties. A Web Governance Committee must also conduct annual audits of Prime websites to check compliance, including business associate agreements with third-party tracking providers.
These obligations are separate from the $20 benefit, depend on final approval and the agreement’s effective date, and do not establish that the alleged conduct occurred at every listed hospital or affected every patient the same way.
When Will Payments Be Sent?
No payment date has been confirmed. The final approval hearing is scheduled for March 9, 2027, at 10 a.m. Pacific Time, at the Spring Street Courthouse of the Los Angeles County Superior Court, 312 North Spring Street, Department 7. The court will consider whether the settlement is fair, reasonable and adequate, along with fees, service awards and administration expenses. The date or time may change, so check the official website.
If final approval is granted, payments will follow once the settlement is final and any appeals are resolved.
Other Healthcare Website Privacy Settlements
Other providers have faced separate pixel-tracking lawsuits, and the rules differ in each. See the USC Arcadia Hospital pixel tracking settlement for another example. Eligibility for one settlement does not establish eligibility for Prime Healthcare’s.
