What Is the Avis Data Breach Lawsuit About?
This lawsuit alleges that between August 3, 2024 and August 6, 2024, Avis experienced a security incident and that, as a result, certain personally identifiable information — including names, driver’s license information, credit card numbers and expiration dates, dates of birth, and phone numbers — was exfiltrated.
The Avis class action lawsuit claimed that the rental car company failed to implement reasonable cybersecurity measures to prevent sensitive consumer information from being accessed without authorization. Who Is Eligible to File a Claim?
You are a Settlement Class Member if you are a United States resident whose private information was compromised in the data security incident Avis experienced between August 3, 2024 and August 6, 2024.
- You may qualify if you received a written notice from Avis Rent A Car System, LLC or Avis Budget Group, Inc. informing you that your personal information was impacted in the August 2024 data breach.
- You may qualify if your name, driver’s license number, credit card number, date of birth, or phone number was exposed in the incident.

How Much Can You Receive?
The settlement offers two separate claim options. You can file for one or both:
Option 1 — Out-of-Pocket Loss Reimbursement (Up to $5,000)
All settlement class members who have suffered a proven monetary loss and who submit a valid claim are eligible for reimbursement up to $5,000.00. To qualify, the loss must be an actual, documented, and unreimbursed monetary loss; must have been more likely than not caused by the data security incident; must have occurred between August 3, 2024 and the claims deadline; and the class member must have made reasonable efforts to avoid or seek reimbursement for the loss, including exhausting available credit monitoring insurance and identity theft insurance.
Examples of qualifying out-of-pocket losses include: unauthorized charges on accounts linked to the breach, costs to freeze or monitor credit, fees paid to recover from identity theft, and related documented expenses.
Option 2 — Pro Rata Cash Payment (No Proof Required)
All settlement class members are eligible to make a claim for a cash fund payment, regardless of whether they make a claim for out-of-pocket losses. The pro rata cash fund payments will evenly distribute the net amount of the settlement fund — after payment of all approved out-of-pocket loss claims, notice and administration expenses, attorney fees, and service awards — to each settlement class member who submits a valid claim.
The exact pro rata payment amount is TBD and depends on the number of valid claims filed and the funds remaining after all deductions.
