What Happened With Vivimed Losartan?

Losartan is a widely prescribed medication that helps control high blood pressure and protect the kidneys. In May 2019, the FDA announced that Vivimed Life Sciences — a pharmaceutical manufacturer based in Chennai, India — had voluntarily recalled 19 lots of its Losartan Potassium Tablets in 25 mg, 50 mg, and 100 mg dosages.

The recall happened because lab testing detected NMBA (N-Nitroso-N-methyl-4-aminobutyric acid), a nitrosamine compound, in the active pharmaceutical ingredient used to make the tablets. The FDA classified NMBA as a probable human carcinogen — meaning it may cause cancer with long-term exposure. Vivimed’s Losartan was distributed in the U.S. through Heritage Pharmaceuticals Inc., based in East Brunswick, New Jersey.

Plaintiffs in the class action lawsuit alleged that Vivimed manufactured and sold contaminated Losartan tablets, causing consumers to pay for a medication that did not meet safety standards. Vivimed denies all wrongdoing but agreed to settle to avoid the costs and risks of continued litigation. This settlement resolves only the economic loss claims — meaning what consumers paid for contaminated pills — not personal injury claims tied to health effects.

Did Your Losartan Qualify? Here’s How to Check

This is the single most important question — and the answer comes down to your medication’s National Drug Code (NDC). Every prescription bottle in the U.S. has an NDC printed on the label. You qualify for this settlement only if your Vivimed Losartan matches one of the eight impacted NDC numbers listed by the court.

The eight qualifying NDC codes are:

  • 23155-644-09
  • 23155-644-10
  • 23155-645-03
  • 23155-645-09
  • 23155-645-10
  • 23155-646-03
  • 23155-646-09
  • 23155-646-10

To find your NDC: Check the label on your Losartan bottle or ask your pharmacy to pull your prescription history. Pharmacies keep detailed dispensing records and can confirm which manufacturer’s product you received and its NDC code.

You may qualify if all of the following apply to you:

  • You are an individual living in the United States, its territories, or possessions.
  • You paid any amount of money out of pocket for retail purchases of Vivimed Losartan finished drug formulations under one of the eight qualifying NDC codes listed above.
  • Your purchase was not covered entirely through a third-party payor (like an insurance company) or a government program (like Medicare Part D or Medicaid).

You do not qualify if you are a Pharmacy Benefit Manager (PBM), a government entity (other than cities, towns, or municipalities with self-funded drug plans), or a personal injury claimant in this MDL. You also do not qualify if you paid nothing out of pocket because your insurer covered the full cost.

How Much Money Can You Receive?

Your payment amount depends on how many 30-day supplies of qualifying Vivimed Losartan you purchased and whether you can document what you paid.

Standard payment — no documentation required: The settlement pays $4.30 for each 30-day supply you purchased, up to a maximum of $43 (ten 30-day supplies). You do not need to submit receipts for this tier. The settlement administrator may still ask you to verify your claim, so it helps to have your pharmacy records ready even if you do not submit them upfront.

Enhanced payment — documentation required: If you paid more than $4.30 per 30-day supply out of pocket, you can claim a higher amount with no per-supply or total cap on the enhanced tier. You must submit pharmacy receipts or records that show what you actually paid. There is, however, an overall cap: total payments to consumers cannot exceed 90% of the net settlement fund after attorneys’ fees, administration costs, and service awards are deducted. If total valid claims exceed that cap, the settlement administrator will reduce all payments proportionally.

Practical note for most patients: If you picked up your Losartan at a retail pharmacy using insurance and paid only a copay, your reimbursable amount is your actual out-of-pocket copay — not the full prescription price. If you paid cash with no insurance, your documented cost is the full retail price per fill.

Frequently Asked Questions

Do I need a lawyer to file a claim?

No. Court-appointed class counsel — including attorneys from Slack Davis Sanger LLP, Honik Law, and Kanner & Whiteley LLC — represent all settlement class members at no charge. Filing a claim yourself is free and straightforward. You only need to hire your own attorney if you want individual representation, which is entirely optional.

Is this settlement legitimate?

Yes. The U.S. District Court for the District of New Jersey authorized and oversees this settlement as part of In re: Valsartan, Losartan, and Irbesartan Products Liability Litigation, Case No. 1:19-md-02875-RBK-SAK. Postlethwaite & Netterville, the court-appointed settlement administrator, manages claims through the only official site: sartanmedicationsettlement.com.

When will I receive my payment?

The court holds its final approval hearing on June 30, 2026. If the judge approves the settlement and no appeals follow, payments go out after that point. The exact timeline depends on how quickly the court resolves any post-hearing appeals and how long claims processing takes — typically several months after final approval.

What if I missed the claim deadline?

The claim deadline is June 2, 2026. If you do not file by that date, you will receive no payment from this settlement. You will also give up your right to sue Vivimed separately for economic losses related to this contamination. File as early as possible — do not wait until the last day.

Will this settlement payment affect my taxes?

Possibly. Cash payments from product contamination settlements may count as taxable income depending on how the IRS characterizes the payment — whether it compensates for a financial loss or constitutes income. Consult a tax professional about your specific circumstances before filing your return.

I don’t have my old pill bottle — can I still file?

Yes. Your pharmacy keeps dispensing records going back several years. Contact your pharmacy and ask for a printout of your prescription history, which will show the manufacturer, NDC code, and what you paid. This record is typically available at no cost and can substitute for a pill bottle label.

Does this settlement cover my health problems from taking contaminated Losartan?

No. This settlement covers only economic losses — meaning what you paid for the medication. It does not compensate for any personal injuries, health conditions, or cancer risks you may associate with the contamination. If you believe you suffered physical harm from NMBA-contaminated Losartan, consult a personal injury attorney about your options, as those claims are separate from this economic loss settlement.

Is this the same as the Valsartan or Irbesartan settlements?

No, but they are part of the same MDL. The Vivimed Losartan settlement ($1,899,000) covers only the eight specific Vivimed NDC codes listed above. Separate settlements exist for Hetero Valsartan ($11,365,489.80) and Aurobindo Irbesartan ($2,000,000) — each with their own qualifying products and NDC codes. All three share the same claim deadline of June 2, 2026 and the same settlement administrator.
