What Is the PharMerica Data Breach Lawsuit About?

According to the complaint, in March 2023, a cybercriminal ransomware group targeted the company’s network and exfiltrated approximately 4.7 terabytes of data, including plaintiffs’ personal information. The ransomware group Money Message claimed responsibility for the attack and posted patient-related data — including names, Social Security numbers, dates of birth, and health insurance information — on the internet. Who Is Eligible to File a Claim?
Anyone in the United States who received official notice that their personal information was compromised in the March 2023 PharMerica data breach is eligible to file a claim.
- You may qualify if you received a letter or email from PharMerica notifying you of the data breach.
- You may qualify if you were a patient at a nursing home, assisted living facility, or other long-term care setting served by PharMerica around March 2023.

How Much Can You Receive?
The settlement offers three benefit tiers. Your payout depends on which tier you qualify for and the documentation you can provide.
Tier 1 — Documented Loss Reimbursement (“Cash Payment A”) — Up to $10,000
Those who submit documented proof of out-of-pocket expenses incurred due to the data breach are eligible to receive a one-time cash payment of up to $10,000. This covers losses related to fraud, identity theft, professional fees, credit repair services, and credit monitoring costs.
Tier 2 — Pro Rata Cash Payment (“Cash Payment B”) — Amount TBD
The court explains that after administration costs, attorneys’ fees, and service awards are approved by the court, remaining funds support cash payments that will go up or down on a pro rata basis depending on how many valid claims are filed. You do not need to show any documented losses to claim this tier.
Tier 3 — Free Credit Monitoring (1 Year)
PharMerica will provide one year of Kroll Complete Monitoring to all class members who file a valid claim. The monitoring package also includes a $1 million identity theft insurance policy.
Note: PharMerica will pay documented loss claim payments and credit monitoring costs separately from the main settlement fund, in addition to $1,741,000 in attorneys’ fees.
