Jimmy John’s $975,000 Washington Job Posting Settlement, Who Gets Paid Without a Claim Form and What the November 13, 2026 Deadline Means (Hill v. Sandwich SC LLC, No. 25-2-08587-2 SEA)
Update log (October 20, 2026): Article published. The opt-out, objection, address-update and digital-payment deadlines are all November 13, 2026. The Final Approval Hearing is January 22, 2027. The court has preliminarily approved the settlement but has not given final approval.
If you applied for a Jimmy John’s job in Washington at any point from January 1, 2023 through August 24, 2026, you may be in a $975,000 class action settlement without knowing it. The lawsuit says Jimmy John’s Washington job postings left out the pay range, or a general description of benefits, that Washington law requires.
There is no claim form. If you are a class member and do nothing, you stay in the settlement and a check is mailed after the court gives final approval. November 13, 2026 is not a claim-filing deadline. It is the deadline to opt out, object, update your mailing address or pick a digital payment. If the administrator has the wrong address for you, you may not get paid.
Sandwich SC LLC denies doing anything wrong, and the court has not decided who is right.

What Jeffrey Hill Claims Sandwich SC LLC Left Out of Its Washington Job Postings
Jeffrey Hill applied for a job with Sandwich SC LLC and sued for himself and other applicants in King County Superior Court. His claim is that the company’s Washington job postings did not disclose the wage scale or salary range, or a general description of the benefits and other compensation offered to the person hired, as RCW 49.58.110 requires.
Sandwich SC LLC denies it broke any law and says the claims lack merit. The settlement is not an admission of wrongdoing. On August 24, 2026, the King County court preliminarily approved the deal and allowed Simpluris to send notice to class members.
What Washington’s Equal Pay and Opportunities Act (RCW 49.58.110) Requires in a Job Posting
The job posting rule sits inside Washington’s Equal Pay and Opportunities Act. Under RCW 49.58.110, an employer with 15 or more employees must include two things in each posting for a specific job opening:
- The wage scale or salary range for the position, or the fixed wage if only one amount is offered.
- A general description of all the benefits and other compensation that will go to the person hired.
The requirement took effect January 1, 2023, which is why that is the first day of the class period. It applies whether the employer posts the job itself or uses a third party.
A prevailing job applicant is entitled to statutory damages between $100 and $5,000 per violation, plus attorneys’ fees and costs. The statute allows three years from the alleged violation to file.
Washington’s 2025 to 2027 Correction Window Under RCW 49.58.110
The current version of RCW 49.58.110 on the Washington State Legislature’s website adds a safeguard for postings made from July 27, 2025 through July 27, 2027. Anyone can send an employer written notice that a posting is noncompliant. If the employer fixes the posting within five business days of receiving that notice, the statute bars penalties, damages and other relief under that section for that violation.
The Jimmy John’s class period runs through August 24, 2026, so it overlaps this window. The settlement website defines the class by the applications and postings described in the Notice and does not say how the correction provision applies to each posting. That is one reason this settlement is not a court finding that Sandwich SC LLC violated the law in every covered instance. It resolves disputed claims without a trial ruling on liability.
Why Statutory Damages Do Not Equal Your Settlement Payment
The $100 to $5,000 statutory range is what a court may award after finding a violation. A negotiated class settlement works differently. Your payment is an equal share of a fixed fund, not a calculation of your individual statutory damages, so do not assume the statutory range translates into your check.
Who Qualifies for the Jimmy John’s Washington Settlement?
You are in the Sandwich SC LLC settlement class if you applied for at least one Jimmy John’s job opening in Washington between January 1, 2023 and August 24, 2026, in response to a posting that allegedly did not disclose the wage scale or salary range and/or a general description of benefits and other compensation, and you do not opt out.
The settlement website says Jimmy John’s records identify class members, who receive a personalized Notice with a LoginID and PIN.
Applied outside Washington? Not covered. The case is built on a Washington law.
Applied to a different Jimmy John’s franchisee? Not automatically covered. The defendant is Sandwich SC LLC, so the question is which legal entity posted the job.
Former or current employee? The class is defined by job applications, not employment status. Being hired or not hired does not change whether you can be a class member, but simply having worked at Jimmy John’s does not make you one.

How Much Will Washington Applicants Get From the Jimmy John’s Settlement?
Every class member who stays in receives an equal share of the net settlement fund. The $975,000 is the total fund, not a per-person amount. The settlement website does not publish a per-person figure or the class size.
Here is what the settlement website confirms:
| Fund item | Amount |
| Total settlement fund | $975,000 |
| Requested attorneys’ fees, costs and expenses (33% of the fund) | $321,750 |
| Requested service award to class representative Jeffrey Hill | $20,000 |
| Remaining if the court approves both requests in full, before administration costs | $633,250 |
Class counsel will ask for the fees and the service award, and Sandwich SC LLC has agreed not to oppose them. The court can award less. The administration cost is not listed on the website, so the final pool is smaller than $633,250. Your payment is that final pool divided by the number of class members.
Taxes on the Jimmy John’s Settlement Payment
The settlement FAQ says payments are treated as non-wage damages and reported on IRS Form 1099 rather than a W-2. How that affects your return depends on your situation, so ask a tax professional.
What to Do Before the November 13, 2026 Deadline
You have four options, and the deadline is the same for all of them.
1. Do nothing. You stay in the class and receive a check by mail after final approval. You also give up the right to sue over the released claims, which are claims through the class period over alleged violations of RCW 49.58.110, including interest, liquidated, exemplary and statutory damages, and attorneys’ fees.
2. Update your address or choose a digital payment. Use the online form at epoasettlementsscl.com, the Address Form that came with your Notice, or write or email the administrator. Have your LoginID and PIN from the Notice ready. The deadline to choose digital payment is November 13, 2026.
3. Exclude yourself (opt out). Mail a letter postmarked by November 13, 2026 to:
Jeffrey Hill v. Sandwich SC LLC c/o Simpluris, Inc. P.O. Box 26170 Santa Ana, CA 92799
Include your full name, address, a statement that you want to be excluded, and your signature and date. Phone, email and group requests do not count. You get no payment but keep your right to sue.
4. Object. If you stay in the class and disagree with the deal, file a written objection with the King County Superior Court at 516 Third Avenue, Room E-609, Seattle, WA 98104. Mail copies to class counsel and Sandwich SC LLC’s lawyers. Everything must be postmarked by November 13, 2026. The Notice lists what an objection must include, such as your contact details, the case name and number, your reasons, and any other class action objections you or your lawyer have filed in the past three years. You cannot both opt out and object. Opting out removes you from the class, while objecting means you stay in it.
How Washington Courts Approve a Class Settlement Like Hill v. Sandwich SC LLC
The case is in King County Superior Court, so Washington Superior Court Civil Rule 23 governs the class procedure. A class settlement cannot take effect on the parties’ say-so. Under CR 23, the court must review the deal and decide whether it is fair, reasonable and adequate, and class members must receive notice and a chance to object or opt out.
That is why the process has two steps. The court gave preliminary approval on August 24, 2026, which allowed notice to go out. After the November 13, 2026 deadline, Judge John McHale will hold the Final Approval Hearing on January 22, 2027 and decide whether to approve the settlement, the attorneys’ fees and the service award. Payments follow only after final approval and any appeals.
