What the Emerald City Pizza Lawsuit Says About Washington Job Postings

What Washington’s Pay Transparency Law Requires of Employers

Washington’s Equal Pay and Opportunities Act requires an employer to disclose in each job posting the wage scale or salary range and a general description of all the benefits and other compensation to be offered to the hired applicant. The statute defines a “posting” as any solicitation meant to recruit applicants for a specific open position, whether the employer does it directly or through a third party, in electronic or printed form, if it includes qualifications for desired applicants. The disclosure rule applies to employers with 15 or more employees.

The requirement took effect on January 1, 2023, which is why that is the start of the class period here. Washington has amended how the law is enforced since then, including changes in 2025, so check the current text of RCW 49.58.110 if you want to know how the rule works for postings today.

Who Qualifies for the Emerald City Pizza Settlement?

How Much Will Emerald City Pizza Settlement Payments Be?

The official website and FAQ do not state a per-person amount or the number of people in the class. They say every class member who does not opt out is eligible for an equal share of the class fund. Payments are characterized as non-wage damages and reported on a 1099.

Class counsel will ask the court to approve these payments from the settlement fund:

  • Attorneys’ fees: $112,800, which is 30% of the $376,000 fund. Emerald City Pizza has agreed not to oppose the request.
  • Litigation costs and expenses: actual costs, up to $5,000.
  • Service award to the plaintiff: $25,000.

If the court grants all three requests in full, $142,800 would come out of the fund, leaving about $233,200 to divide among class members before settlement administration costs. What You Give Up by Staying in the Emerald City Pizza Class
