What Is the Nice-Pak Data Breach Lawsuit About?

Nice-Pak Products Inc. is one of the world’s largest manufacturers of pre-moistened wipes — producing consumer brands including Wet Ones and WipesPlus, as well as store-brand wipes for major retailers. Professional Disposables International Inc. (PDI) is a subsidiary or affiliate producing professional-grade healthcare and hygiene wipes. Between May 28 and June 15, 2023, cybercriminals gained unauthorized access to computer systems belonging to Nice-Pak and PDI, accessing files containing the personal, financial, and medical information of approximately 8,500 current and former employees and customers.

Plaintiff Johnson and other affected individuals filed the class action lawsuit Johnson et al. v. Nice Pak Products, Inc. et al., Case No. 1:23-cv-01734, alleging Nice-Pak and PDI failed to implement adequate cybersecurity safeguards to protect the sensitive personal information they stored. The lawsuit raised claims of negligence, negligence per se, and breach of implied contract — arguing that employees and customers reasonably expected their employer and business partner to keep their most sensitive data secure. Nice-Pak and PDI denied all allegations but agreed to settle to avoid the risk and expense of continued litigation.

What Personal Information Was Exposed?

The May–June 2023 cyberattack potentially compromised the following categories of sensitive information:

  • Full names and contact information
  • Social Security numbers
  • Financial account data
  • Medical information

The combination of Social Security numbers, financial account data, and medical information creates a heightened risk of both financial fraud and medical identity theft. Given that this breach primarily affects employees — whose tax, payroll, and benefits information is routinely held by employers — Social Security numbers and financial account details from direct deposit records are particularly likely to have been among the exposed data. Enrolling in the three-year Privacy Shield Pro monitoring is strongly recommended alongside any cash claim you file.

Who Is Eligible to File a Claim?

  • You may qualify if you are a current or former employee of Nice-Pak Products Inc. or Professional Disposables International Inc. who received a breach notification about the May–June 2023 incident.
  • You may qualify if you are a customer of Nice-Pak or PDI who received a breach notification about the same incident.
  • You do not qualify if you did not receive a breach notification from Nice-Pak or PDI about this specific May–June 2023 cyberattack.

Your settlement notice contains a unique ID and PIN required to file your claim online. Check your mail and email — including spam folders — for correspondence from Nice-Pak Products, PDI, or the Nice-Pak Settlement Claims Administrator. If you believe you qualify but did not receive a notice, contact Simpluris at 844-341-0324 or [email protected] before the May 12, 2026 deadline.

How Much Can You Receive?

The settlement offers four separate benefit options. You can claim multiple options if you have qualifying documentation.

Benefit TypeMaximum AmountProof Required
Ordinary Out-of-Pocket ExpensesUp to $450No for claims up to $50; Yes (receipts/invoices) for claims over $50
Extraordinary Out-of-Pocket ExpensesUp to $4,500Yes — bank statements, police reports, proof of exhausting insurance
Lost Time ReimbursementUp to $90 (4 hrs × $22.50/hr)Written description and attestation

Ordinary losses cover documented, unreimbursed out-of-pocket expenses directly caused by the breach — including fees for freezing or unfreezing your credit, credit monitoring or identity theft insurance costs, professional fees such as attorney or accountant fees, and other miscellaneous breach-related costs. Claims up to $50 require no documentation. Claims above $50 require receipts or invoices.

Extraordinary losses cover up to $4,500 in documented monetary losses from identity theft or fraud that the breach most likely caused. You must show you exhausted all available insurance or reimbursement options before filing this tier. Supporting documentation must include bank or credit card statements showing fraudulent charges, police reports, and other third-party proof of fraud directly related to the breach.

Lost time covers up to four hours at $22.50 per hour — a maximum of $90 — for time you spent responding to the breach. This includes time spent monitoring accounts, placing credit freezes, contacting your bank, or researching identity protection steps. Provide a written description of your activities and the time spent, attested under penalty of perjury.

Privacy Shield Pro provides three years of comprehensive privacy protection including dark web watchlist monitoring, a VPN, private search, password defense, a digital vault, and data broker opt-out services. You can enroll using the code in your settlement notice — no claim form is required and enrollment can happen after the claim deadline.

Frequently Asked Questions

Do I need a lawyer to file a claim in this settlement?

No. You can file your claim directly at nicepaksettlement.com without hiring an attorney. Class counsel already represents all class members at no individual cost. If you want independent legal advice about your specific situation, you may hire your own attorney at your own expense. Contact Simpluris at 844-341-0324 or [email protected] with any questions.

Is this Nice-Pak settlement legitimate?

Yes. The settlement, Johnson et al. v. Nice Pak Products, Inc. et al., Case No. 1:23-cv-01734, is a court-supervised class action. The official settlement website is nicepaksettlement.com, administered by Simpluris, Inc. Verify any communication by calling 844-341-0324 or emailing [email protected].

When will I receive my payment?

The final approval hearing is scheduled for June 12, 2026. Simpluris will issue payments approximately 60 days after the court grants final approval or after claim processing is complete — whichever is later. Most claimants can expect payments in late 2026 if no appeals delay the process.

What if I miss the May 12, 2026 claim deadline?

If you do not file a claim by May 12, 2026, you will not receive any cash payment from this settlement. You can still enroll in the Privacy Shield Pro monitoring using your notice’s enrollment code after the deadline. You will also remain bound by the settlement’s release of claims against Nice-Pak and PDI — unless you opted out before April 13, 2026.

Will this settlement payment affect my taxes?

Settlement payments may count as taxable income depending on the nature of the compensation and your individual tax situation. Simpluris will issue appropriate tax documentation if required. Consult a qualified tax professional to understand how to report your payment on your return.

What is Privacy Shield Pro and how is it different from standard credit monitoring?

Unlike basic credit monitoring that only tracks credit file changes, Privacy Shield Pro offers broader digital privacy protection — including dark web watchlist monitoring, a VPN to protect your internet connection, private search to prevent tracking, password defense, a digital vault for secure document storage, and data broker opt-out services that actively remove your personal information from data aggregator websites. The three-year term provides significantly longer coverage than the one- or two-year monitoring offered in most other data breach settlements.

As an employee, was my payroll or tax information likely exposed in this breach?

Employers like Nice-Pak typically store sensitive employee information including Social Security numbers (for tax filings), direct deposit financial account details, health insurance and benefits information, and in some cases medical data from employee health plans. All of these categories were confirmed as potentially affected in this breach. If you were a Nice-Pak or PDI employee, your payroll tax records, W-2 information, and direct deposit banking details may all be at elevated risk. Monitor your bank accounts, tax filings, and credit reports closely and file your claim before the May 12, 2026 deadline.

Can I claim both ordinary losses and extraordinary losses?

Yes. Ordinary losses (up to $450) and extraordinary losses (up to $4,500) are separate benefit tiers that you can claim simultaneously if you have qualifying documentation for both. Ordinary losses cover general breach-response expenses. Extraordinary losses cover actual fraud or identity theft you suffered as a direct result of this breach. Claiming both — along with lost time and Privacy Shield Pro monitoring — gives you the maximum possible benefit from this settlement.
