If you paid HealthPort Technologies (now Datavant LLC) for copies of Pennsylvania medical records connected to a life or health insurance application, you may be able to recover 67.5% of the amount you allegedly overpaid. Patients, patient designees and patient representatives are covered, and the settlement website describes the class as including lawyers, law firms and companies that requested and paid for the records.

Two earlier deadlines are close: objections must be received by November 2, 2026, and opt-out requests must be received by November 16, 2026. Those dates are only days away.

Who Qualifies?
The settlement class is defined as all patients, patient designees and patient representatives who:
- requested medical records from a Pennsylvania healthcare provider or facility in connection with a patient’s application for life and/or health insurance, which HealthPort calls an “underwriting” request;
- paid HealthPort more than the maximum basic, search and retrieval, and/or reproduction fees allowed under 42 Pa.C.S. § 6152(a)(2)(i) of the Pennsylvania Medical Records Act;
- were not charged under an agreed-upon rate; and
- made the payment between December 17, 2009 and July 23, 2026.
Excluded are HealthPort’s present or former counsel in the case, the court and its immediate family and staff, and class counsel.
Who this can include. The settlement website’s notice describes the class as including patients, individuals, lawyers, law firms and companies that requested the records and paid for them. What matters is the role you played in the transaction and whether it meets the definition above.
Pennsylvania connection. The test is where the records came from, a Pennsylvania provider or facility, not necessarily where you live. A Pennsylvania resident whose request involved an out-of-state provider, or a request that had nothing to do with a life or health insurance application, would not automatically qualify.
Class size. In the settlement agreement, HealthPort/Datavant represents that about 2,056 persons or entities in the class made a combined 15,149 record requests.

Is this the same as the Landay v. Datavant settlement?
No. The settlement website says that other notices you may have received, relating to Landay v. Datavant, concern a different lawsuit with different deadlines. Check the case name and number on every notice before acting.
What the Lawsuit Claims
The lawsuit, filed in December 2013, alleges that HealthPort violated the Pennsylvania Medical Records Act by charging more than the state “ceiling” for copies of medical records. It is brought as a breach of implied contract claim and seeks money for alleged overpayments on behalf of a class.
HealthPort denies the allegations. It argues that:
- the Medical Records Act does not apply to records requested by a third party in connection with a patient’s application for health or life insurance; and
- the payments were consented to and made voluntarily with full knowledge of its charges, so the claims are barred by “prior approval” or the voluntary payment doctrine.
The court has not decided who is right. The settlement is a compromise, and HealthPort does not admit wrongdoing or liability.
Is this a data breach settlement?
No. This case is about fees charged for copies of records, not about stolen or exposed personal information.
The Laws Behind the Case
This is general legal background, not legal advice. The settlement agreement and court orders control.
| Law or rule | What it does | Why it matters here |
| Pennsylvania Medical Records Act, 42 Pa.C.S. § 6152 | Sets maximum fees that providers and their copy vendors may charge for copies of medical records, including a basic fee, a search and retrieval fee, and per-page copying fees | The “ceiling” HealthPort is alleged to have exceeded |
| § 6152(a)(2)(i) | The specific fee provision named in the settlement’s class definition | Defines what counts as an overpayment |
| Fee adjustments | The statute provides for periodic updates to the fee limits, so the maximum allowed depends on the year of the request | Explains why each request’s alleged overpayment is calculated individually from its date and page count |
| Implied contract | A court can find an agreement from the parties’ conduct even without a signed contract | The legal theory the plaintiff used to recover the overcharges |
| Voluntary payment doctrine | A person who pays with full knowledge of the facts generally cannot get the money back later | HealthPort’s main defense |
| Pa.R.C.P. 1701 et seq. | Pennsylvania’s class action rules, including conditional class certification for settlement under Rule 1707 | The basis for treating the case as a class action for settlement only |
| Pa.R.C.P. 1714 | Requires court approval, after a hearing, of a class action settlement | Why there is a notice period and a fairness hearing |
How the court reviews a settlement. At the fairness hearing, Judge Hertzberg will decide whether the settlement is fair, reasonable and adequate, and will hear any properly filed objections.
How Much Can You Get?
If you file a valid, timely claim, you receive 67.5% of the Alleged Overpayment on each of your record requests.
What “Alleged Overpayment” means. It is the amount by which the basic fee, search and retrieval fee and/or per-page reproduction fee you actually paid exceeded the statutory maximums, calculated using the number of pages in that record request. Only amounts greater than zero count. If no overpayment is identified for a request, it produces no benefit.
It is not 67.5% of everything you paid. It is 67.5% of the portion above the legal ceiling.
| Alleged overpayment on a request | Calculated benefit at 67.5% |
| $20 | $13.50 |
| $50 | $33.75 |
| $100 | $67.50 |
| $200 | $135.00 |
| $500 | $337.50 |
These are examples of the formula, not predictions of what any person will receive.
What Is the $197,720.39 Cap?
The settlement agreement says HealthPort/Datavant will make $197,720.39 available to pay valid claims. The agreement also says the total benefits are calculated as 67.5% of the total Alleged Overpayment.
- If valid claims exceed $197,720.39, they are paid pro rata.
- If valid claims are less than the amount funded, unused money is returned to HealthPort/Datavant.
- There is no guaranteed minimum payment.
What that suggests for typical amounts. By simple arithmetic, $197,720.39 spread across about 2,056 class members is roughly $96 per class member, or about $13 per record request across 15,149 requests. These are rough averages for context only, not predictions. Individual amounts vary widely with the number of requests and pages, and many people may receive less, while a few may receive more.
Are Attorneys’ Fees Taken From Your Payment?
No. HealthPort/Datavant pays these separately, subject to court approval:
- Attorneys’ fees and costs of no more than $65,906.80
- A $2,500 service award to the class representative, P.I.T. Retrievals, LLC
- Notice and administration costs
None of these reduce the $197,720.39 available to class members. The court can award less than requested.
How to File a Claim
You must file a Proof of Claim through the settlement website. It must be signed (electronically is allowed) under penalty of perjury and received by 11:59 p.m. Eastern time on December 31, 2026. Do not wait until the last day.
- Find your Notice ID and PIN on the notice mailed to you. Together they are your Class Member ID.
- Open the online claim portal: https://www.healthportpitsettlementpa.com/page/preclaim
- Log in and review your Transaction List. It shows, for each request attributed to you, the invoice number, invoice date, the patient whose records were requested, the healthcare provider, the amount HealthPort’s records show was paid, and the settlement benefit available.
- Check every entry. You may claim all listed transactions in a single Proof of Claim, or select only specific transactions.
- Choose your payment method and submit.
Payment options in the agreement: paper check, Zelle, PayPal, Venmo, electronic Mastercard, or ACH. If you do not give enough information for an electronic method, or it cannot be completed, you are paid by mailed check.
Verification. The administrator may ask for more information to confirm a claim is valid.
What If You Did Not Receive a Notice or Cannot Find Your ID?
Contact the administrator right away at 1-800-657-1193, by email at [email protected], or by mail at P.I.T. Retrievals v. HealthPort Technologies, LLC, c/o Settlement Administrator, PO Box 23309, Jacksonville, FL 32241. Do not contact the court or Judge Hertzberg’s staff.
Moved, Changed Your Name, or Is the Class Member Deceased?
| Situation | What to do |
| New address | Use the Update Address page with your Notice ID and PIN, or email the administrator with “Change of Address” in the subject line, or mail the information to the address above |
| Name change | Send a copy of your marriage license, divorce decree or court order, with your Notice ID and old and new details, with “Name Change” in the subject line |
| Class member has died | Send a death certificate and documents showing the new payee, such as a will or estate paperwork |
Date Issue to Watch: Transactions After 2014
The class period runs from December 17, 2009 through July 23, 2026. But the settlement agreement says HealthPort/Datavant reviewed its records and identified underwriting requests from December 17, 2009 through December 31, 2014, and certifies that all transactions that can be identified from its records have been identified.
In practical terms, the Transaction List you see is built from that data.
If you made a qualifying request after 2014, or a transaction you believe qualifies is missing from your list, contact the administrator before the deadline. Ask whether it is covered and how to raise it. Do not assume it is either covered or automatically excluded.
Your Options
| Option | What it means | Deadline |
| File a claim | The only way to receive money, if the settlement is approved and becomes final | December 31, 2026 |
| Do nothing | No payment, and you still give up the released claims | N/A |
| Opt out | No payment, but you keep the right to sue HealthPort on your own | November 16, 2026 |
| Object | You stay in the class and tell the court why you disagree | November 2, 2026 |
| Speak at the hearing | File a written Notice of Intention to Appear | November 2, 2026 |
What Happens If You Do Nothing?
You receive nothing. Unless you opt out, you are still bound by the settlement and its release, even if you never file a claim or never receive money. You cannot sue, continue to sue, or join another lawsuit against HealthPort over the issues that were or could have been raised in this case. If you already have your own lawsuit pending, talk to your lawyer immediately.
How to Opt Out
Opting out means no money, but you are not bound by the release.
Requirements:
- In writing, with your original signature
- Sent by first-class mail, postage prepaid, and received by November 16, 2026. A postmark does not count.

How to Object
You can object only if you stay in the class. You may object to any part of the settlement, including class certification, whether it is fair, reasonable and adequate, the adequacy of class counsel or the class representative, and the requested fees and service award.
Each objection must be in writing and include:

If you are represented by a lawyer, that lawyer must file a written Notice of Appearance with the Department of Court Records by November 2, 2026 and list each earlier class action in which they represented an objector. An objection that does not follow these steps may not be considered.
The Fairness Hearing
- When: December 1, 2026, at 12:00 p.m.
- Where: Room 816, City-County Building, 414 Grant Street, Pittsburgh, PA
- Do you have to go? No. A timely, proper objection will be considered whether or not you attend.
- To speak: file a Notice of Intention to Appear, and send copies to both counsel, so that it is received by November 2, 2026. You cannot speak if you opted out.
What You Give Up
If the settlement becomes final and you did not opt out, you release HealthPort/Datavant and related parties from claims that arise from the acts, omissions, facts and transactions alleged in the case, or that could have been alleged. This covers claims for damages, interest, penalties and fees tied to those facts, whether known or unknown. The release applies whether or not you file a claim. The agreement’s Release of Claims section sets out the exact wording, so read it if you are unsure.
When Will Payments Be Made?
Not until the settlement is approved and becomes final. The agreement works like this:
- The court holds the fairness hearing on December 1, 2026 and decides whether to grant final approval.
- If approved, an Effective Date occurs only after the appeal period passes with no appeal, or after all appeals are resolved.
- HealthPort/Datavant must fund the settlement account within 14 days of the Effective Date.
- Checks go out within about 30 days after the Effective Date, and electronic payments are processed under the agreement.
The settlement website warns that appeals can take time, perhaps more than a year.
Cash paper checks quickly. Checks must be cashed within 90 days of the date printed on them and are not valid afterward.
If the settlement fails. The agreement can be terminated if the court declines to approve it or the Effective Date never occurs. In that case, no claims are paid and no one’s claims are released.
Beware of Scams
You never have to pay a fee to file a claim in this settlement. Use only the official website and the administrator contact details in this article, and do not share your Notice ID and PIN with anyone you did not contact yourself. The court will not call you about the settlement.

Other HealthPort and Datavant Settlements
Other medical-records-fee cases involving HealthPort or Datavant are separate lawsuits with different case numbers, class periods and payment formulas. A transaction listed in one settlement does not automatically qualify in another. If you received more than one notice, read each one and use only the website for that particular case.
