Ebara Technologies $1.2 Million California Wage Settlement, Who Qualifies and How Workweek Payments Work
Ebara Technologies Incorporated has agreed to pay $1,200,000 to resolve a class and Private Attorneys General Act (PAGA) lawsuit over California wage-and-hour claims. The case is Lal v. Ebara Technologies Incorporated, No. 23CV012499, in Sacramento County Superior Court (Department 8B, Judge Peter K. Southworth).
Status as of October 29, 2026: The court granted preliminary approval on August 28, 2026, subject to the parties clarifying the class release and revising the notice. The settlement is not final. The final approval hearing is January 22, 2027, at 9:00 a.m. in Department 8B of the Tani G. Cantil-Sakauye Courthouse. No claim form is required. Payments are calculated from the company’s records of workweeks.
Ebara denies liability. The allegations have not been proven, and the settlement is not a finding that the company broke the law.
Ebara Technologies Settlement Eligibility Checklist: Are You a Class Member?
You are likely covered if all of these apply:
- [ ] You worked for Ebara Technologies Incorporated in California.
- [ ] You were a non-exempt, hourly employee. Salaried workers classified as exempt are not covered.
- [ ] You worked at any time between November 30, 2019 and August 22, 2025. Even one week in that period counts toward the class.
PAGA group: If you worked as a non-exempt, hourly employee in California between November 30, 2022 and August 22, 2025, you are also a PAGA member and receive a share of the PAGA payment.
Former employees are included. Current employment is not required.

What Does the Ebara Technologies Settlement Pay? Fund Breakdown
The $1.2 million is the gross amount. These items come out of it first, based on the court’s ruling:
| Item | Amount |
| Gross settlement fund | $1,200,000 |
| Attorneys’ fees (requested) | Up to $400,000 (one-third) |
| Litigation costs (requested) | Up to $25,000 |
| Class representative payment | Up to $10,000 |
| Settlement administration (CPT Group) | $7,500 |
| PAGA penalties | $60,000 |
| Net class settlement fund | About $697,500 |
Ebara pays its share of payroll taxes separately, not from the $1.2 million. The court approved the fee, cost, and payment requests only preliminarily. Class counsel must back up the fee request with a lodestar analysis and actual cost figures before final approval.
How Your Ebara Workweek Payment Is Calculated
- The administrator divides the net fund (about $697,500) by the total number of workweeks for all class members. That gives a workweek value.
- Your payment is your credited workweeks times the workweek value.
- PAGA members’ $15,000 share is split the same way, using workweeks in the PAGA period.
More workweeks means a larger payment. The workweek value is unknown until the administrator counts everyone’s workweeks and the net fund is final.
For scale only: plaintiff’s counsel reported that Ebara produced records for 225 putative class members. If the net fund were split among about 225 people, the rough average would be about $3,100 before taxes. That is not a prediction. Actual payments depend on workweeks, participation, and final approval.
Ebara Technologies 45-Day Deadline: How to Find Your Date
Class members have 45 calendar days from the date the administrator first mails the notice to ask to be excluded, object, or dispute their workweek count. The deadline is the same for all three.
How to find yours:
- Look at your notice for the mailing date and the response deadline printed on it. The date in your notice controls.
- If you cannot find it, count 45 days from the mailing date.
- If the 45th day falls on a Sunday or a state holiday, the deadline moves to the next day the Postal Service is open.
- If your notice was re-mailed to a new address, you get either 15 extra days or until the original response deadline, whichever is later, to ask for exclusion or object.
Example (illustration only): If notices were mailed on November 2, 2026, the 45th day would be December 17, 2026.
Where the notice stands: The agreement gave Ebara 20 days after preliminary approval to send the class list to the administrator, and the administrator 10 more days to mail notices. The court asked for a revised notice and compliance hearing (September 11, 2026), so the exact mailing date could not be confirmed. If you worked for Ebara in the covered period and have not received a notice, contact class counsel at (888) 510-7725 and make sure your current address is on file.

Do You Need to File a Claim Form in the Ebara Technologies Settlement?
No. Payments go to participating class members automatically using Ebara’s employment records. You act only if you want to:
- Dispute your workweek count. Compare the number on your notice with your own records, such as pay stubs, schedules, and start and end dates, and follow the notice’s dispute instructions with proof.
- Opt out of the class portion. You receive no class payment and are not bound by the class release.
- Object to the settlement. You stay in the class and remain bound if the court approves the settlement.
PAGA members cannot opt out of the PAGA portion or object to the PAGA amount.
What Did the Ebara Technologies Lawsuit Allege?
Sarvesh Lal filed the lawsuit on November 30, 2023, and gave notice to the California Labor and Workforce Development Agency on December 7, 2023. The first amended complaint, filed April 19, 2024, alleges:
- Overtime unpaid (Labor Code §§ 510, 1198).
- Minimum wages unpaid (§§ 1182.12, 1194, 1197, 1197.1, 1198), including off-the-clock work.
- Meal and rest periods not properly provided (§§ 226.7, 512(a), 516, 1198).
- Wage statements and payroll records that did not comply (§§ 226(a), 1174(d), 1198).
- Final pay and regular pay not made on time (§§ 201, 202, 204).
- Business expenses not reimbursed (§ 2802).
- PAGA civil penalties (§ 2698 et seq.) and unfair business practices (Bus. & Prof. Code § 17200 et seq.).
Class counsel’s case page also lists claims over the regular rate of pay and sick-leave pay rates. The settlement resolves the claims in the complaint and does not decide whether each one is true.
How Strong Was the Case? The Exposure Estimate
According to the court’s ruling, plaintiff’s counsel valued Ebara’s risk-adjusted exposure at about $1,505,163.54. The largest items were rest period claims (about $688,189) and meal period claims (about $344,094). Reviewing time and pay records for 225 putative class members, counsel reached the settlement after a mediation and a mediator’s proposal. The $1.2 million is about 80% of that estimate. This is counsel’s estimate, not a court finding.
How Ebara Settlement Payments Are Taxed
- 20% of each class payment is treated as wages (IRS Form W-2).
- 80% is treated as non-wages (IRS Form 1099-MISC).
- PAGA payments are non-wages (Form 1099-MISC).
Keep your tax forms. If you are unsure how to report the money, ask a tax professional.
Why the Judge Raised a Concern About the Ebara Class Release
The court said the class release may be too broad because it covers claims that “could have been alleged” in connection with any fact mentioned in the complaint. The judge recommended narrowing it to claims alleged, or reasonably alleged, from the facts in the complaint or PAGA notice, to match the PAGA release. The parties must address this before final approval, and the notice must be revised if the release changes. Read the release language in your notice before you decide to stay in or opt out. The named plaintiff gave a general release.
When Will Ebara Settlement Checks Be Mailed?
No payment date is set. Under the agreement:
- Ebara deposits the fund and employer payroll taxes within 30 days after the Effective Date.
- The administrator issues payments within 10 days after funding.
- The Effective Date is final approval, or 61 days after final approval if someone objects (and later if an objector appeals).
- Checks uncashed 180 days after issue go to the State Bar of California’s Justice Gap Fund.
