Dartmouth College $750,000 Data Breach Settlement, File a Claim by October 21

If you received a Dartmouth College data breach notice in November 2025, you may be eligible to claim money from a $750,000 settlement.

The deadline to submit a claim is October 21, 2026. Eligible settlement class members can request an estimated $75 pro rata cash payment without documenting a loss, or seek up to $5,000 for documented out-of-pocket losses tied to the data incident. The settlement also offers two years of one-bureau credit monitoring.

The $75 payment is only an estimate. The final amount can increase or decrease depending on the number and value of valid claims and other payments from the $750,000 settlement fund.

The settlement has received preliminary approval, but final approval has not yet been granted. U.S. District Judge Alan D. Albright has scheduled the final approval hearing for November 5, 2026, at 9 a.m. Central Time in the Western District of Texas.

Who Qualifies for the Dartmouth College Data Breach Settlement?

You may be included if you meet both of these conditions:

  1. You are a living individual residing in the United States; and
  2. Dartmouth sent you notice that your private information may have been affected by the data incident.

The potentially affected information includes some combination of names, dates of birth, Social Security numbers and financial account information.

Eligibility is based on Dartmouth’s notice records. Simply attending Dartmouth, working for another organization that uses Oracle software, or having used an Oracle product does not by itself establish eligibility for this particular settlement.

Who Is Excluded From the Settlement Class?

The settlement excludes certain categories of people, including Dartmouth directors, officers, members and agents and certain related entities; governmental entities; the assigned judge, the judge’s immediate family and court staff; people found criminally responsible for initiating, causing, aiding or abetting the data incident; and people who validly and timely exclude themselves.

How Much Money Can You Get From the Dartmouth Settlement?

There are two cash options.

Estimated $75 Cash Payment (No Documentation)

Class members can claim Cash Payment B, which does not require documentation of an individual financial loss. The website currently estimates it at $75, but the amount is not guaranteed.

The payment is calculated pro rata, meaning it can go up or down depending on the total value of valid claims and the money remaining in the fund after other authorized expenses and benefits are paid. Do not describe this settlement as guaranteeing every claimant $75.

Up to $5,000 for Documented Losses

Cash Payment A allows an eligible class member to request reimbursement for qualifying out-of-pocket losses related to the data incident, up to $5,000 per person.

Reasonable documentation is required. The official FAQ gives examples such as telephone records, correspondence including emails, and receipts. A personal certification, declaration or affidavit by itself is not enough, though it may add context to other records. Expenses already reimbursed from another source cannot be claimed again.

The $5,000 figure is a maximum, not an automatic payment.

Two Years of Credit Monitoring

Eligible class members can also request two years of credit monitoring from one credit reporting agency. The package includes dark-web monitoring, up to $1 million in identity-theft insurance, up to $1 million in unauthorized electronic funds transfer reimbursement, real-time monitoring, and help with identity-theft victims and security freezes.

This benefit is available in addition to the cash options, subject to the settlement’s terms.

What Happened in the Dartmouth College Data Breach?

The settlement concerns a cybersecurity incident involving Oracle E-Business Suite (Oracle EBS), an enterprise software system used by Dartmouth. According to the court-authorized notice, a previously unknown vulnerability in Oracle EBS allowed an unauthorized third party to access certain private information from environments used by Oracle EBS customers, including Dartmouth. Dartmouth sent notice in November 2025.

The broader litigation involves Oracle and multiple organizations that used Oracle EBS. This settlement resolves claims against Trustees of Dartmouth College only, not every claim against every defendant.

What Does the Lawsuit Allege?

The plaintiffs alleged that Dartmouth failed to adequately protect private information involved in the Oracle EBS incident. Dartmouth denies the allegations and denies wrongdoing or liability.

The FAQ states the court has not determined that Dartmouth committed wrongdoing or violated any law. The parties settled to avoid the risks, costs and time of continued litigation. The $750,000 is a resolution of disputed claims, not a finding of legal responsibility.

Is the Dartmouth $750,000 Settlement Final?

Not yet. The court granted preliminary approval, allowing notice and claims to proceed. The final approval hearing is set for November 5, 2026, at 9 a.m. Central Time before Judge Albright.

At the hearing, the court is scheduled to consider whether the settlement is fair, reasonable and adequate, and whether to approve requested attorneys’ fees, costs and service awards. Benefits are provided only after court approval and once the settlement becomes final. Filing a claim does not mean you will be paid immediately.

Opt-Out and Objection Deadlines

Opt-Out Deadline: October 6, 2026

To exclude yourself, submit a written request postmarked by October 6, 2026, with the information required by the notice, including the case name and number, your identifying information and a signed statement requesting exclusion. If you opt out, you cannot receive settlement benefits, but you keep the ability to pursue your own lawsuit over the released claims, subject to applicable law and the settlement’s terms.

Objection Deadline: October 6, 2026

Class members who remain in the settlement can object to it. The written objection must be filed with the court and sent to the relevant attorneys and administrator by October 6, 2026, and must include details establishing class membership and the grounds for the objection.

An objection is different from opting out. An objector stays in the class and is bound by the settlement if the court approves it.

Attorney Fees and Taxes: General Information

Attorney fees. In class settlements, class counsel typically asks the court to approve fees and expenses from the settlement fund, and courts commonly award a percentage of the fund. Fees, administration costs and service awards are generally paid before money is distributed to claimants, which can affect the pro rata payment. Check the official website for the exact amounts counsel requests.

Taxes. Tax treatment depends on your situation. Reimbursement of actual out-of-pocket losses is often treated differently from a payment made without proof of loss, which may be taxable income. This is general information only. Consult a tax professional about your own circumstances.
