Corteva $35M FTC Pesticide Settlement, 12 States, 10-Year Loyalty Program Ban and What Farmers Should Know
Corteva, Inc. agreed to pay $35,000,000 to 12 states and to stop its pesticide loyalty program for 10 years, resolving the FTC and state antitrust claims against Corteva. What Did the FTC and States Allege Against Corteva’s Pesticide Loyalty Program?
The FTC and state attorneys general sued Corteva and Syngenta on September 29, 2022. The complaint alleged that each company paid distributors end-of-year rewards for buying all, or nearly all, of their yearly needs for certain pesticide active ingredients from that company. That left distributors buying very little from lower-priced generic competitors.
According to the government, generics should be able to enter and push prices down once patents and regulatory exclusivity periods expire, but the loyalty programs kept them out of an essential sales channel. The government alleged American farmers overpaid as a result. Corteva has not admitted the allegations. A federal judge denied both companies’ motions to dismiss on January 12, 2024.
Which 12 States Are Receiving Corteva’s $35 Million?
The FTC’s co-plaintiffs are California, Colorado, Illinois, Indiana, Iowa, Minnesota, Nebraska, Oregon, Tennessee, Texas, Washington and Wisconsin. The FTC says Corteva must pay the $35,000,000 to the state plaintiffs to resolve their monetary claims.
Iowa’s attorney general said Iowa will receive approximately $2.4 million. Other states have not all announced their shares.
Can Farmers File a Claim in the Corteva $35 Million Settlement?
No claim form or deadline has been announced. The money goes to the states, not to a court-run fund for farmers, and the FTC’s announcement does not describe any farmer claims process.
According to the proposed order, the states may use their shares for several purposes, including antitrust enforcement, state funds, agricultural programs and distribution to farmers as an attorney general sees fit. That means some farmers may eventually benefit, but no state has been shown to require payments to individual farmers, and no payment formula exists.
Be careful with any website that claims to be a “Corteva settlement claims administrator.” If a state attorney general later creates a farmer payment program, that office will announce the rules and deadline.

What Does the Corteva Settlement Require Corteva to Change?
For 10 years, the proposed stipulated order would prohibit Corteva from:
- Conditioning payments to a distributor on buying more than 50% of its requirements for a pesticide active ingredient from Corteva.
- Limiting a distributor’s purchases of generic products to less than 50%.
- Using a volume-based loyalty program to recreate a banned share-based program.
- Using other specified conditions that boost the exclusionary effect of the program on generics.
- Discriminating against or threatening customers who refuse those terms or who do business with generic makers.
The order covers all of Corteva’s post-patent active ingredients, not just the three examples named in the complaint.
Does the Corteva Settlement Resolve the Syngenta Antitrust Case?
No. The FTC says the settlement resolves only the claims against Corteva, and litigation against Syngenta remains ongoing.
Has a Judge Approved the Corteva FTC Settlement?
