Zumba Fitness $2.7 Million Video Privacy Class Action Settlement, Who Qualifies, Payment Amounts, No Claim Form and December 14 Deadline

Zumba Fitness, LLC has agreed to pay $2.7 million to settle Kueppers et al. v. Zumba Fitness, LLC, a certified class action alleging that tracking technology on Zumba.com disclosed customers’ names and course purchases to Meta, Pinterest and MNTN in violation of the federal Video Privacy Protection Act (VPPA). Zumba denies wrongdoing, and the court has not decided who is right.

There is no claim form. If you are a class member and the court grants final approval, you are paid automatically. The deadline to opt out or object is December 14, 2026. The final approval hearing is January 21, 2027 at 1:00 p.m. Eastern.

Who Qualifies

You are in the class only if all three apply:

  1. You live in the United States.
  2. You bought the online, on-demand version of the Zumba Basic 1 instructor-training course (called “ZB1 OD Version”) from Zumba.com between October 22, 2022 and October 22, 2024.
  3. Your first and last names appeared on order-confirmation pages, reachable at ZB1 OD Version order URLs, that one or more of the identified third-party advertisers had.

The settlement is not a general payout for every Zumba customer. It does not cover in-person classes, other products, unrelated subscriptions or watching other Zumba videos. Buying the course alone does not make you a class member if the name and order-confirmation records did not appear.

The Three Subclasses

Class members belong to one, two or all three subclasses, depending on which company could access their records. The court’s order reports these subclass sizes, which overlap:

SubclassMembers
Meta disclosure subclass1,576
Pinterest disclosure subclass3,061
MNTN disclosure subclass2,665
Total shares (1,576 + 3,061 + 2,665)7,302 shares across 4,543 people

If You Did Not Get a Notice

Notices went out by email or postcard starting October 15, 2026, using Zumba’s records and certain third-party records. If you think you qualify but received nothing, contact the administrator to check whether you are in the class:

  • Email: [email protected]
  • Phone: (866) 382-0528
  • Mail: Zumba VPPA Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958

Only use the official website and contacts. Do not enter personal information on other sites offering a “Zumba settlement payment.”

How Much Will You Get?

The net fund is divided into shares, and each qualifying subclass earns one share. If no one opts out, there are 7,302 shares among 4,543 people, and the official FAQ says each share should be worth at least $229.33.

Subclasses you are inMinimum estimated payment
One$229.33
Two$458.66
Three$687.99

Payments could be higher if people opt out, costs come in under estimates or the court awards less than the fees requested. Your notice states your own amount. Some summaries show an estimate of about $228.78, a difference of under a dollar that reflects different assumptions about administration costs. Use the figure in your notice.

Where the $2.7 Million Goes

ItemAmount
Settlement administrationUp to $32,095 (reported)
Class counsel attorneys’ fees requested$900,000 (one-third of the fund)
Litigation expenses requested$97,350.81
Remaining for class membersAbout $1.67 million (our subtraction)

The fees and expenses are requests. The judge decides what to award. Class counsel has called the deal the largest of its kind under the VPPA, which we could not verify independently.

What You Need to Do

Nothing, to get paid. If you stay in the class and the court approves the settlement, you receive payment without filing anything.

Optionally, use the official portal to update your mailing address or choose electronic payment, using the login ID and PIN printed on your notice. The reported cutoff is January 24, 2027. Without a selection, you receive a paper check at the address on file. Deposit checks promptly, because they can expire.

Never pay anyone to “file” a claim for this settlement. No claim is needed.

How to Opt Out

Mail a signed request to Zumba VPPA Settlement, ATTN: Exclusion Request, P.O. Box 25226, Santa Ana, CA 92799-9958, postmarked by December 14, 2026. Include your full name, mailing address, email address, signature, the case name and number, and a statement that you want to be excluded. You can opt out only yourself.

How to Object

An objection must follow the notice’s requirements and be filed or mailed as specified by December 14, 2026. It generally must identify the case, give your name and contact information, name any lawyer representing you, state the factual and legal basis for your objection and show you are a class member. If you object, you remain in the class. If you opt out, you cannot object as a class member.

Which Option Is Right for You?

That is a personal decision. Staying in gives you automatic payment but releases the covered claims. Opting out preserves whatever individual rights you have, subject to the law, defenses and deadlines, but you get nothing from the settlement. Individual VPPA claims can be difficult and costly to pursue, and the VPPA allows liquidated damages of $2,500 for a proven violation, which is far more than the settlement share. A lawyer can tell you whether your situation justifies opting out. The release terms are in the settlement agreement on the official website.

Final Approval Hearing and Payment Timing

Judge Dimitrouleas will decide whether the settlement is fair, reasonable and adequate under Federal Rule of Civil Procedure 23(e). He will consider valid objections and rule on the fee and expense request. You do not have to attend. If you object and want to speak, follow the notice’s procedure for appearing. Dates can change, so check the website.

The administrator says payment will go out within 60 days after final approval if no appeal is filed, or within 60 days after an appeal ends. Some summaries say about 90 days. Rely on the notice and official FAQ. No payment date is guaranteed as of October 20, 2026, and the January 21 hearing is a decision point, not the mailing date.

What the Lawsuit Alleges

Named plaintiffs Catherine Kueppers of Florida and Kathleen Summy of Wisconsin bought on-demand access to Zumba instructor-training course videos on Zumba.com. They allege that Zumba put tracking technology, including a Meta pixel and a Pinterest tag, on its site, and that it sent their personal information and purchase details to Meta, Pinterest and MNTN without consent. Zumba denies this.

A tracking pixel is a small piece of code that lets a third party receive information about activity on a website, such as page URLs and identifiers. Businesses use pixels to measure ads and build audiences. The legal issue is not that tracking exists, but whether identifiable customers’ video purchases were disclosed to third parties without the consent the law requires.

The Video Privacy Protection Act

Congress passed the VPPA in 1988 after a newspaper published a Supreme Court nominee’s video rental history. Under 18 U.S.C. § 2710:

  • A “video tape service provider” may not knowingly disclose a consumer’s personally identifiable information, which includes information identifying a person as having requested or obtained specific video materials.
  • Disclosure with the consumer’s informed, written consent is allowed. The consent must be in a form distinct from other legal or financial agreements, and it can be given in advance for a limited period or until withdrawn.
  • A person harmed can sue for actual damages, with a floor of $2,500 in liquidated damages, plus punitive damages, attorney’s fees and equitable relief. The time limit to sue is generally two years from the violation or its discovery.

The VPPA is not a blanket ban on tracking. A claim depends on whether the defendant is a covered provider, whether the plaintiff is a “consumer,” whether the information qualifies as personally identifiable information, whether there was a knowing disclosure and whether an exception applies. Federal appeals courts have disagreed on parts of these questions, including who counts as a consumer and how to judge whether information is identifying, which is why VPPA outcomes vary by circuit.

Court History

DateEvent
October 23, 2024Lawsuit filed in the Southern District of Florida
May 8, 2025Court denies Zumba’s motion to dismiss, finding the allegations stated a VPPA claim
July 28, 2026Court denies Zumba’s motion for judgment on the pleadings
August 19, 2026Judge Dimitrouleas certifies the class and three subclasses (some reports say August 20)
October 15, 2026Notice mailing
December 14, 2026Opt-out and objection deadline
January 21, 2027Final approval hearing

On the motion to dismiss, the court was persuaded that disclosed URLs for pages tied to the purchased video could be enough to show disclosure of specific video materials, even without video titles. Class certification means the case could proceed as a class action. It is not a finding of liability, and the settlement ends the case without one.

Taxes

Settlement payments may be taxable income. The tax treatment depends on your situation, and a payment of this kind generally is not compensation for physical injury. Ask a tax professional if you are unsure.
