Benworth Capital Partners Data Breach Settlement, Claim $50 or Up to $5,000 by December 21, 2026
If Benworth Capital Partners LLC sent you a letter saying your personal information may have been exposed in its May 2025 data breach, you may be able to claim cash from a class action settlement. You can choose an estimated $50 with no paperwork or up to $5,000 for documented losses. Everyone in the class also gets one year of free credit monitoring.
The claim deadline is December 21, 2026, which is 55 days from today. The deadline to opt out or object is earlier, December 4, 2026. The court has not yet granted final approval, and the hearing is set for January 5, 2027, at 8:45 a.m. ET.
Benworth denies wrongdoing, and the court has not decided who is right. The case is Amanda Arreola, et al. v. Benworth Capital Partners LLC, Case No. CACE-26-012064, in the Circuit Court of Broward County, Florida. The official website is BenworthDataSettlement.com.

What Happened in the Benworth Capital Partners Data Breach
According to the settlement website, an incident on or about May 18, 2025 led to unauthorized access to, or acquisition of, personal information that Benworth collected. The data involved names, addresses, telephone numbers, loan account information and Social Security numbers.
The Social Security numbers are why this matters even if you have not seen any fraud. That number does not change, and criminals can use it years later. The settlement materials do not say that every class member had every category exposed, or that everyone suffered fraud. Your Benworth notice is the best source for which categories were involved in your case.
Benworth denies wrongdoing. The settlement is not a finding that its security practices broke the law.
Who Qualifies for the Benworth Data Breach Settlement
You are a Settlement Class Member if you are a living individual residing in the United States and Benworth sent you notice that your private information may have been affected. The class is notice-based. Having a loan with Benworth does not automatically qualify you.
The class excludes:
- Benworth’s directors, officers and agents.
- Governmental entities.
- The judge, the judge’s immediate family and court staff.
- Joseph Boggan, who is named in the class definition.
- Anyone who properly opts out.
You can qualify even if you have not had identity theft or lost money. The $50 option requires no proof of loss, although you must still file a valid claim.
If you are not sure whether you are covered, or you lost your notice, call the administrator at (833) 360-6904 or email [email protected].

What the Benworth Data Breach Settlement Pays
| Benefit | Amount | What you need |
| Documented losses (Option 1) | Up to $5,000 | Documentation of reasonable losses fairly traceable to the data incident |
| Alternative cash payment (Option 2) | Estimated $50 | Nothing beyond the claim form |
| Credit monitoring | One year, free | Nothing; the activation code is printed on your notice |
You choose one cash option, not both.
Option 1: Up to $5,000 for documented Benworth breach losses
A loss qualifies if it is an actual, documented, unreimbursed monetary loss, was more likely than not caused by the data incident, and happened after the incident. Fraud and identity theft losses are the stated examples. Acceptable proof includes telephone records, emails and receipts. Self-prepared documents such as handwritten receipts can support other proof but are not enough alone.
You cannot be reimbursed for something another source already paid, including through a credit monitoring or identity theft product. If your documentation is missing or incomplete and you do not fix it, the claim is denied. The $5,000 is a cap, not an automatic payment.
Option 2: The estimated $50 Benworth payment
You do not need receipts or proof of identity theft. The settlement website calls this an “estimated” payment, and the pages reviewed do not say whether the final amount can change. Check the Settlement Agreement if that matters to you.
Free credit monitoring from the Benworth settlement
You do not need to file a claim to get the activation code, but you can activate it only after the court grants final approval. Keep your notice. Activation is through CyEx Financial Shield Complete. If you lost your code, contact the administrator, or use the Enrollment Instructions Request page with your Login ID and PIN.
Do not wait for final approval to protect yourself. Watch your accounts and credit reports, and be careful with messages asking you to verify a Social Security number or make a payment. You can also place a free security freeze with the credit bureaus, as the FTC’s credit-freeze guidance explains.
How to File a Benworth Capital Partners Settlement Claim
The online form requires the Login ID and PIN printed at the top of your notice. If you lost them, email [email protected] with your full name and mailing address.
- Find your notice and your Login ID and PIN.
- Pick one cash option. If you choose documented losses, gather your records first.
- File online at the official claim page, or download the paper form from the documents page.
- Attach evidence if you are claiming documented losses.
- Submit by December 21, 2026. Online claims must be submitted by that date. Mailed claims must be postmarked by that date and sent to: Benworth Settlement, Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799.
The administrator warns that the Postal Service often does not postmark mail the day you drop it off. It recommends mailing at least a week early, getting a manual postmark at a post office, or using Certified Mail. Keep a copy of your claim and confirmation. Filing does not guarantee payment.

Should You Opt Out of, Object to, or Ignore the Benworth Settlement?
Do nothing. You get the credit monitoring code but no cash. You are also bound by the settlement and give up the right to sue Benworth over the same claims. The release is in Section XI of the Settlement Agreement.
Opt out. You get no benefits, including no cash, and you keep the right to sue on your own. Mail a written request postmarked by December 4, 2026 to the address above. It must include your name, address, phone number, email, signature and a statement that you want to opt out of the Arreola v. Benworth settlement class (Case No. CACE-26-012064). You cannot opt out by phone or email. If you opt out by mistake, contact the administrator to withdraw the request and then file a claim.
Object. You stay in the class and can still file a claim. Your objection must be filed with the court so it arrives by December 4, 2026, and copies must be sent to class counsel, Benworth’s counsel and the administrator by the same date. The site requires your reasons, how many other class settlements you have objected to in the past five years, the lawyers involved, and whether you or your lawyer used artificial intelligence to prepare the objection. You must sign it personally. A lawyer’s signature is not enough. See the official FAQ for addresses.
Which Laws Apply to the Benworth Capital Partners Data Breach Case?
The settlement website and FAQ do not list every cause of action in the underlying complaint. It would be inaccurate to say a particular law was violated just because the parties settled. The following is background.
Florida Information Protection Act, Fla. Stat. § 501.171
Under Florida Statutes § 501.171, covered entities must take reasonable measures to protect electronic personal information. The statute also requires notice to affected Florida residents in qualifying breaches, generally without unreasonable delay and no later than 30 days after determining a breach occurred, subject to exceptions. It treats combinations such as a name and Social Security number as protected personal information. The settlement summary does not confirm that a violation of § 501.171 was pleaded against Benworth, and the statute’s relevance does not mean Benworth violated it.
Negligence and contract claims in data breach lawsuits
Data breach suits often allege negligence, which generally requires a duty, a breach, causation and damages, and sometimes contract-based claims over how personal information was handled. The settlement materials do not list the operative complaint’s counts, so neither should be treated as a confirmed claim in this case. The Settlement Agreement’s release decides which claims are resolved.
Court approval of the Benworth class settlement
A class settlement does not establish that the defendant did anything wrong. The Broward County court must decide whether to approve it, and at the January 5, 2027 hearing it will also address objections, attorneys’ fees and costs, and service awards. Benefits are paid only if the court approves.
Who Represents the Benworth Settlement Class?
Class counsel are Jeff Ostrow of Kopelowitz Ostrow P.A. and Mariya Weekes of Milberg PLLC. Benworth is represented by John T. Mills of Gordon Rees Scully Mansukhani LLP.
Class counsel will ask the court for up to $750,000 in fees and costs and up to $2,000 per class representative in service awards. The settlement site says Benworth would pay these amounts, not individual class members, and the court can award less. You do not need your own lawyer to file a claim.
When Will Benworth Settlement Payments Be Sent?
No payment date has been announced. Benefits go out only if the court approves the settlement at the January 5, 2027 hearing, and appeals or other delays could affect timing. The settlement website says only that the process may take time.
How the Benworth Settlement Compares With Other Data Breach Settlements
Terms differ from case to case, so do not assume payout rules carry over. The ARcare $3.9 Million Data Breach Class Action Settlement, Claim Up to $5,000 or an Estimated $100 by January 7, 2027 uses a similar structure but has its own eligibility rules and deadline. The CBIZ $485,000 Data Breach Settlement, Claim About $100 or Up to $5,000 Before December 24, 2026 is another open claim period with different terms. The claims period for the Cencora Data Security Settlement, Check If You Qualified — Anaya, et al. v. Cencora, Inc., No. 2:24-cv-02961-CMR (Claims Closed) has closed. None of these changes what is available under the Benworth agreement.
