Four Days in August 2024 That Put 299,000 Renters at Risk

Between August 3 and August 6, cybercriminals infiltrated a business application connected to Avis’s network, exploiting vulnerabilities and extracting sensitive customer information. Avis discovered the breach on August 5 and worked to contain it, but the damage had already been done.

The exposed data included names, addresses, email addresses, phone numbers, dates of birth, driver’s license numbers, and partial credit card numbers. Hackers reportedly posted this information on the dark web, increasing the likelihood of identity theft and financial fraud for the affected individuals.

Plaintiff Jason Shay filed the first class action complaint against Avis Rent A Car System LLC on September 18, 2024, in New Jersey federal court, alleging negligence and inadequate security measures. The lawsuit argued that Avis collected and stored sensitive customer data as a routine part of the rental process, and that its failure to adequately protect that data constituted a breach of its duty to customers. Avis denies the allegations but agreed to settle to avoid the cost and uncertainty of further litigation.

Did You Rent From Avis? Here’s Whether You’re Covered.

You may qualify if:

  • You are a U.S. resident whose personal information was compromised in the Avis data breach that occurred between August 3 and August 6, 2024
  • You received a breach notification letter from Avis (sent around September 5, 2024)
  • Your data — including name, driver’s license number, date of birth, credit card details, or other personal information — was among the approximately 299,066 records exposed

You do not qualify if:

  • You did not have personal information involved in the August 2024 breach specifically
  • You are a Google employee, officer, or director of Avis, or a judge assigned to this case

Avis told Maine’s attorney general that it notified affected customers on September 5, 2024. If you rented from Avis around the breach period and did not receive a notice, you can contact the settlement administrator directly at (888) 818-4234 or by emailing the administrator through AvisDataSecuritySettlement.com to confirm whether your information was included.

Up to $5,000 If You Have Receipts — or a Smaller Payment If You Don’t

This settlement offers two separate tracks, and you can file for both.

Track 1 — Documented Out-of-Pocket Losses (up to $5,000)

Class members can claim up to $5,000 in documented, unreimbursed monetary losses that are traceable to the data breach. The losses must have occurred between August 3, 2024, and June 21, 2026, and class members must have made reasonable efforts to avoid or seek reimbursement for the loss, such as by using credit monitoring or identity theft insurance.

Eligible documented losses include unreimbursed bank fees from fraudulent charges, costs of placing credit freezes or fraud alerts, identity theft repair expenses, and time spent dealing with fraud at a self-documented rate. Supporting documentation such as receipts, bank statements, or credit card statements showing fraudulent activity is required.

Track 2 — Pro-Rata Cash Payment (no documentation required)

All class members can submit a claim to receive a pro-rata cash payment from the net settlement fund after the settlement administrator pays all other claims. The settlement administrator will determine the final payment amount based on the total number of claims filed.

Given the $1.02 million fund and approximately 299,066 affected individuals, the pro-rata payout will be modest — exact amounts are TBD until claims are tallied.

Frequently Asked Questions

I never saw fraud on my accounts — can I still file?

Yes. You do not need to show actual fraudulent charges to receive the pro-rata cash payment. The exposure of your personal data to hackers is sufficient to qualify. You only need documentation if you are claiming the higher out-of-pocket losses reimbursement of up to $5,000.

What exactly was stolen in the Avis breach?

The exposed data included names, addresses, email addresses, phone numbers, dates of birth, driver’s license numbers, and partial credit card numbers. The combination of driver’s license numbers and birth dates is particularly sensitive because it enables identity fraud well beyond simple credit card misuse.

Do I need a lawyer to file a claim?

No. You can file directly at AvisDataSecuritySettlement.com without any legal representation. If you want to object to the settlement terms or opt out entirely to preserve your right to sue Avis independently, consulting an attorney before the May 22, 2026 deadline is advisable.

Is this settlement legitimate?

Yes. The case is In re: Avis Rent A Car System LLC Security Incident Litigation, filed in the U.S. District Court for the District of New Jersey. The settlement administrator is Angeion Group LLC, a court-approved administrator. The only official settlement website is AvisDataSecuritySettlement.com. You can call (888) 818-4234 to verify details.

When will I receive my payment?

The settlement administrator will issue payments approximately 30 days after it approves claims or 90 days after the court grants final approval of the settlement, whichever is later. The final fairness hearing is July 28, 2026, so payments are unlikely before late 2026 at the earliest, and potentially later if appeals are filed.

What if I missed the claim deadline?

If you miss the June 21, 2026 deadline, you will remain in the settlement class, give up your right to sue Avis separately over this breach, and receive no money. Contact the administrator at (888) 818-4234 before the deadline if you have any issues accessing the claim form.

Will this settlement payment affect my taxes?

Possibly. Payments that compensate for documented out-of-pocket financial losses may be treated differently than general cash payments. The administrator will issue tax forms where legally required. Consult a tax professional for advice specific to your situation.

I didn’t get a notice letter — does that mean I’m not included?

Not necessarily. Avis told Maine’s attorney general that it notified approximately 299,000 affected customers on September 5, 2024. If you rented from Avis during or before August 2024 and never received a notice, contact the settlement administrator directly to confirm whether your records were part of the breach.
