How Payments Are Calculated
Payments are strictly workweek-based. There are no tiers based on the type of violation you experienced.
The settlement administrator will divide the net settlement amount by the total number of workweeks all participating class members worked. Each class member’s payment equals the net settlement amount divided by total class workweeks, multiplied by their individual workweeks worked.
For PAGA payments, the administrator divides the $17,875 allocated to aggrieved employees by the total number of PAGA pay periods all aggrieved employees worked. Each aggrieved employee’s PAGA payment equals $17,875 divided by total PAGA pay periods, multiplied by their individual pay periods.
Assumed per-workweek value for examples below: Net class fund of ~$300,000 ÷ estimated 15,000 total class workweeks = ~$20 per workweek. This is an illustrative assumption only. Actual value depends on total workweeks logged by all class members.
Payment Examples
High Scenario — Long Employment, Full Class Period
- Workweeks during class period: 130 (approximately 2.5 years, full-time)
- Per-workweek value: ~$20
- Class payment: 130 × $20 = ~$2,600
- Plus PAGA share (illustrative): ~$15
- Estimated total: ~$2,615
Mid Scenario — One Year of Employment
- Workweeks during class period: 52
- Per-workweek value: ~$20
- Class payment: 52 × $20 = ~$1,040
- Plus PAGA share (illustrative): ~$6
- Estimated total: ~$1,046
Low Scenario — Short-Term or Seasonal Worker
- Workweeks during class period: 8
- Per-workweek value: ~$20
- Class payment: 8 × $20 = ~$160
- Plus PAGA share (illustrative): ~$1
- Estimated total: ~$161
Disclosure: These figures are illustrative only. The actual per-workweek value depends on the final net fund amount and total workweeks worked by all participating class members. These are not guaranteed payment amounts.
Who Is Eligible
Class members must have worked in California as a nonexempt hourly employee for Ready Pac Foods Inc., Ready Pac Produce Inc., OTS Solutions LLC, or Eclipse Advantage LLC (if assigned to a Ready Pac location), and must have worked at least one day from Sept. 8, 2022, through May 11, 2025.
You are NOT eligible if you:
Are an OTS Solutions LLC or Eclipse Advantage LLC employee who was never assigned to a Ready Pac location, or are a California hourly employee who worked for Bonduelle Inc., Bonduelle USA Inc., Bonduelle US Holding Inc., Bonduelle Fresh Americas, Salad Time LLC, Missa Bay LLC, or Ready Pac Florence Partnership during the relevant period.
What You Need to Do
Class members do not need to file a claim to receive a payment. Class members will automatically receive a check by mail at their last known address.
The only actions you may need to take:
- Update your address if you have moved since working at Ready Pac. Contact the administrator at the mailing address above.
- Challenge your workweek count if you believe the number attributed to you is wrong. Class members who believe the number of workweeks or pay periods attributed to them is incorrect may submit pay stubs or other records to challenge the calculation.
- Opt out by April 20, 2026 if you want to preserve the right to sue the companies independently.
Frequently Asked Questions
Do I need to file a claim form? No. Payments are automatic and mailed to your last known address. Update your address with the administrator if you have moved.
How much will I get? It depends on how many weeks you worked during the class period. Based on an estimated net class fund of ~$300,000, each workweek is worth approximately $20. A one-year employee could receive roughly $1,000; a two-year employee roughly $2,000.
What violations does this settlement cover? The settlement covers failure to pay overtime and double-time wages at the correct rate, missed meal and rest breaks, inaccurate wage statements, and failure to pay all wages due at separation.
Does this cover OTS Solutions or Eclipse Advantage workers? Yes, if you were assigned to a Ready Pac location. Workers from those companies who were never placed at a Ready Pac facility are excluded.
What is the PAGA payment? PAGA stands for California’s Private Attorneys General Act. The PAGA employee portion of $17,875 is divided among aggrieved employees based on the number of pay periods each worked during the PAGA period. It is separate from and in addition to your class payment.
When will I receive my check? Expect checks approximately 44 days after final court approval. If the July 17, 2026 hearing goes smoothly with no appeals, payments could arrive by September 2026.
Did Ready Pac admit wrongdoing? No. The companies denied all wrongdoing but agreed to settle to avoid the cost and uncertainty of continued litigation.
What if I think my workweek count is wrong? Contact the administrator and submit pay stubs or employment records to dispute the count before the opt-out deadline.
