CommuniCare $1M Nurses Settlement, Filipino Nurses Trapped by Stay-or-Pay Contracts Can Now Claim Settlement Money
CommuniCare Family of Companies and its Philippine recruiting partner WorldWide HealthStaff Solutions agreed to pay $1,000,000 — plus cancel roughly $1,200,000 in nurse debt — to settle a federal class action. The lawsuit alleged the companies failed to pay nurses for time worked and illegally forced nurses to repay immigration costs for their work visas. Foreign-trained RNs sponsored by CommuniCare between February 17, 2013, and October 13, 2025, may file a claim. The deadline is June 4, 2026.

Where Things Stand Right Now
- U.S. District Judge Michael Barrett preliminarily approved the settlement and certified a class of approximately 220 nurses across Ohio, Pennsylvania, Indiana, Maryland, Missouri, West Virginia, and Virginia.
- The case still awaits a final approval hearing — the court must sign off before payments go out.
- Class members who want the additional FLSA collective payment must opt in by submitting a claim form online or by mail, postmarked by June 4, 2026.
What CommuniCare and WorldWide Actually Did to These Nurses
Registered nurse Ariane Rose Villarin filed the case in February 2023, accusing CommuniCare and WorldWide of binding foreign-educated nurses to work contracts that required repayment of visa and recruiting costs if they left their jobs early. The contracts required nurses to stay for three years or repay up to $16,000 — money the companies characterized as immigration “advances.”
Villarin alleged she was assigned as many as 40 long-term care patients at a time without adequate nursing assistants, often working 50 to 55 hours a week while only being paid for 40. When she quit after two months, she faced the prospect of a five-figure debt. Other nurses were not just threatened — CommuniCare filed lawsuits against more than a dozen nurses for $100,000 or more each after they left before the three-year mark.
The National Labor Relations Board separately issued a complaint against CommuniCare, alleging the stay-or-pay agreement was aimed at forcing employees to remain employed against their will and did not advance any legitimate business interest. The lawsuit covered claims under the Fair Labor Standards Act and other federal wage laws.
Do You Qualify to File?
To be eligible, you must meet all three of the following criteria: you are a foreign-trained registered nurse, CommuniCare sponsored you through the immigration process, and you worked for CommuniCare at any time from February 17, 2013, through October 13, 2025.
You may also qualify if:
- You paid CommuniCare any money as a penalty for leaving before your contract ended
- You worked unpaid overtime or through meal breaks at a CommuniCare facility
- You want to pursue additional FLSA overtime claims by opting into the settlement collective
Geographic coverage includes Ohio, Pennsylvania, Indiana, Maryland, Missouri, West Virginia, and Virginia. The administrator identifies class members from CommuniCare and WorldWide’s own employment records, so you do not need to prove your employment yourself.
How Much Money You Can Actually Get
The settlement delivers two types of relief, and the amounts vary based on your situation.
Cash payments from the $1,000,000 fund:
Nurses who previously repaid part of the contractual penalties will receive approximately 50% of whatever amount they paid back. Remaining funds will be distributed to all class members based on how long each nurse worked with the company. Because the payout is pro-rata across roughly 220 nurses, your individual amount depends on the total number of valid claims submitted.
Debt cancellation worth ~$1,200,000:
Both companies agreed to forgive all existing and potential repayment obligations — meaning CommuniCare and WorldWide will no longer pursue nurses for unpaid contract penalties, and any pending debt is wiped out. For nurses still carrying that threat, this relief alone can be worth thousands of dollars.
Any unclaimed settlement funds remaining after 180 days will be donated to the Human Trafficking Legal Center.

Questions Nurses Are Actually Asking
Do I need a lawyer to file a claim?
No. The settlement administrator handles the claims process directly. You can submit your form online or by mail without hiring an attorney. If you have complex questions about your specific situation, class counsel at Katz Banks Kumin LLP represented the nurses in this case and may be able to help.
Is this settlement real, and how do I know it is not a scam?
Yes. U.S. District Judge Michael Barrett in the Southern District of Ohio preliminarily approved the settlement. The administrator, Atticus Administration, is a court-appointed, independent claims processing firm. You can verify the case at CourtListener under docket number 1:23-cv-00097.
When will I actually receive my payment?
Payments go out only after the court grants final approval and any appeals are resolved. That timeline is TBD. Check for updates at the official settlement website or by contacting Atticus Administration directly.
What if I already paid CommuniCare the penalty money when I quit?
That is specifically addressed in the settlement. Nurses who already paid back the contractual penalty will receive approximately 50% of that amount as a cash reimbursement, on top of any pro-rata share based on their length of employment.
What if I missed the claim deadline?
If you miss the June 4, 2026, deadline, you generally lose your right to receive a cash payment from this settlement. Contact Atticus Administration before the deadline if you have trouble accessing the claim form.
Will this settlement payment show up as taxable income?
Portions of your payout tied to wage claims — such as unpaid overtime — are typically treated as wages and may be subject to income tax. Debt cancellation may also carry tax implications in some cases. Consult a tax professional if your payment is substantial, and the administrator will issue appropriate tax forms.
I am still working for CommuniCare. Can I still file?
Yes. The settlement class includes current employees sponsored through the immigration process between February 17, 2013, and October 13, 2025. Filing a claim does not affect your current employment status.
What happens to the debt CommuniCare says I owe for leaving early?
Under the settlement terms, both CommuniCare and WorldWide agreed to cancel all current and future repayment demands for class members. They will not pursue those claims against any class member, regardless of whether that nurse files a claim.
