Settlement 1: $425 Million — Capital One 360 Savings Account Interest Rate

What It’s About

The lawsuit alleges that Capital One failed to raise interest rates on the 360 Savings account commensurate with rates paid on the 360 Performance Savings account, deceptively marketed the 360 Savings account, and concealed that 360 Savings was no longer Capital One’s high-yield online savings account and concealed the existence of the 360 Performance Savings account — and its higher interest rate — to 360 Savings accountholders.

The current version is a revised settlement with updated 2026 deadlines, after a prior settlement proposal was rejected at a court hearing on November 6, 2025.

Who Is Eligible

Consumers who had a Capital One 360 Savings account at any point between September 18, 2019, and June 16, 2025, may be eligible to receive a cash payment from the $425 million settlement. This includes current and former account holders. The settlement also applies to joint and co-holders, but only the primary account holder will receive any available settlement payment for each account.

What You Get

The revised settlement provides two main benefits: a $425 million settlement fund to pay cash payments to current and former 360 Savings accountholders, and an interest rate match benefit for current 360 Savings accountholders, designed to treat them the same as 360 Performance Savings accountholders for at least two years after the settlement becomes effective.

Settlement 2: ~$4 Million — Capital One Shopping Affiliate Marketing Commission

What It’s About

Capital One has agreed to pay approximately $4 million to resolve allegations that its Shopping browser extension diverted affiliate commissions from content creators. The claim deadline is April 17, 2026.

The creators alleged that the Capital One Shopping browser extension, which has more than 10 million users, erroneously reflected Capital One as the source of referral traffic at checkout, making it appear as if consumers had clicked the bank’s referral links before making purchases. This allegedly enabled Capital One to collect millions of dollars in commissions that rightfully belonged to bloggers, influencers, YouTubers, and other content creators.

Who Is Eligible

The Settlement Class consists of all persons (including entities) in the United States who participated in an affiliate commission program with an online merchant that also partnered with Capital One Shopping between January 6, 2020, and December 18, 2025, and who were involved in a transaction in which Capital One Shopping was also involved.

This includes bloggers, YouTubers, podcasters, social media influencers, website owners, and any other online publisher who earns commissions through affiliate marketing programs.

What You Get

Two payment options are available — you may only choose one:

Proof Payment (full commissions): Settlement Class Members who can demonstrate qualifying transactions by submitting a valid Proof Payment Claim Form will receive the amount of commission received by Capital One Shopping for all qualifying transactions posted on or after November 1, 2023.

Alternative Payment ($20 flat): Capital One class members without proof, or whose transactions occurred prior to November 1, 2023, may instead file a claim form for an alternative $20 cash payment. Capital One must be able to sufficiently indicate, based on its information, that the class member was affiliated with the commission program.

Settlement 3: $2.4 Million — Capital One FCRA “Wrongly Reported Deceased”

What It’s About

The Capital One class action lawsuit alleged that the banking giant wrongfully reported some of its credit card holders as deceased to several credit reporting agencies and failed to investigate the errors despite receiving disputes, in violation of the Fair Credit Reporting Act.

Being reported as deceased to a credit bureau causes serious real-world harm — credit cards get frozen, loan applications are denied, and financial accounts are flagged or closed.

Who Is Eligible

The deal covers approximately 1,142 people who were reported as deceased by Capital One to credit reporting agencies based on information related to their credit card accounts, about whose credit card accounts Capital One received one or more disputes from credit reporting agencies between August 13, 2019 and December 3, 2025, and for whom Capital One did not correct the “deceased” credit reporting in response to the disputes.

What You Get

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits. Payment amounts are pro-rated based on the net settlement fund after attorneys’ fees and costs.

Settlement 4: $190 Million — 2019 Capital One Data Breach (CLOSED for New Claims)

Status: Claim Filing Closed — Free Monitoring Still Available

The Order and Judgment Granting Final Approval of Class Action Settlement was granted on September 13, 2022. The deadline to file a claim for Lost Time or Out-of-Pocket Losses was September 30, 2022. All payment activities to Claimants in this Settlement have completed and no further payment reissue requests will be accepted.

If you missed the 2022 claim deadline, you cannot receive a cash payment. However, you can still access free protective services.

What Is Still Available (Free — No Deadline)

The only active benefits currently available to Settlement Class Members are Identity Defense Services and Restoration Services provided by the Settlement, which have been extended through February 13, 2028.
