The $92M Settlement: What Happened and Why It’s Over
In August 2022, a federal judge in Illinois granted final approval to the $92 million settlement resolving over 20 class action lawsuits alleging TikTok unlawfully collected users’ biometric and personal data — including through facial recognition — in violation of Illinois privacy law, the Computer Fraud and Abuse Act, the Video Privacy Protection Act, and other state statutes.
About 1,215,541 valid claims were ultimately approved. Most nationwide class members received approximately $27 in the first payment wave, while Illinois subclass members received roughly six times that amount due to the state’s biometric privacy laws. A final supplemental distribution went out in late 2025.
Because the March 1, 2022 deadline has passed, there is currently no way to newly qualify or file a claim. Anyone who missed the deadline forfeited their share permanently.
What’s Active in 2026: Three Live TikTok Battles
1. Teen Mental Health MDL — 2,325+ Cases, Trials Now
As of February 2026, there were 2,325 actions pending in the social media MDL — In re: Social Media Adolescent Addiction/Personal Injury Products Liability Litigation, MDL No. 3047 — covering claims against TikTok, Meta, Google, and Snap.
In January 2026, TikTok settled the first social media harm bellwether trial just hours before jury selection — without disclosing terms. That settlement resolved TikTok’s involvement in an individual case brought by a minor but does not resolve the more than 1,000 other cases pending in Los Angeles County Superior Court.
California state trials are proceeding on the following schedule: March 9, 2026 and May 11, 2026 state court trial dates are currently set. These bellwether outcomes are expected to drive broader settlement negotiations across the MDL.
These are individual personal injury lawsuits, not a class action with a claim form. Each case is evaluated separately based on documented harm. Families must retain an attorney to participate.

2. TikTok Children’s COPPA Lawsuit — DOJ Filed, Parents Can Join
The government’s lawsuit alleges TikTok violated the Children’s Online Privacy Protection Act by knowingly allowing children under 13 to create accounts and collecting extensive personal data — including names, email addresses, phone numbers, location data, device information, viewing habits, and persistent identifiers — without notifying parents or obtaining consent.
In June 2025, a federal court appointed Cohen Milstein as interim lead counsel for the multidistrict litigation, clearing the path for parents to take action. Other firms including Silver Golub & Teitell LLP, Lexington Law Group LLP, and Seeger Weiss LLP also represent plaintiffs.
